Well, it's not a fact, but my opinion that she is there. The camera went to the woman who had the IPAD (or whatever she had), and the female next to her looked like Love, IMO, and she had a winter knit cap that had "LOVE" painted on the front in big red letters -- so I leapt to that conclusion... but I could be wrong...
It seems overly tedious to have to check yes or no next to each of 38 mitigating circumstances. These instructions are so verbose. The jurors are probably thinking "please can we go decide now?"
Also, there are 38, count em 38, mitigating factors. I'm still surprised that the State pursued the DP. IMO, many of the MF's are valid and I don't consider myself a softie. I couldn't sentence him to death, but it would scare me if he were ever to have any chance of parole. To me, he's the worst case scenario of what happens to the throwaway children.
This case could be the base for an American Crime miniseries. That show is gut wrenching to me, as is this case. Nothing brings Melissa back. I hate that her family had to sit through this because he wouldn't take a plea for LWOP.

Finally caught up.
Waller's presentation was fantastic and passionate. A++ for the effort there.
Smith is deserving of the death penalty, I see now why the aggravating factors outweigh the mitigating factors. At the same time, he did have a horrible childhood and I do believe he was in an abusive situation. That's not a good excuse for entering someone's apartment, with weapon(s), and brutally killing a helpless woman in her bed. It is the worst fear of many.
And how heinous in addition, they stayed to rifle through things, they probably opened the door to Hannah's bedroom (blood on doorknob, remember). How did they know there was a little girl in that room? Remember they said they were happy 'the little girl' didn't wake up. The only way they could have known that is they saw the little girl in her bed. And they would have killed that 8 yr old child if she had woken up and come to see what was going on. They basically admitted as much.
It's a very tough decision this jury faces. Some first degree murder cases are more obvious than others when it comes to death. I can support any decision the jury makes, my hope is whatever they decide it's unanimous and this phase isn't a default to LWOP based on jurors being hung.
