The Creech family are NOT considered mandated reporters....NOT medical, educational nor LEO individuals involved with the victim. SO, unlike the fictional TV Steinfeld story, no "regular" person has an obligation IN MANY IF NOT ALL STATES to contact authorities when witnessing a crime (or even a possible crime event) nor an obligation to provide assistance.

HOWEVER, if I were one of the "authorities" in Smithfield, I'd be tearing apart every code available (housing, public health, etc.) to find SOMETHING to make this case a "teaching moment" for the folks of the community & especially for the Creech characters! (so wanted to use another term but not willing to "time out"!:blushing:).

But it says right on the North Carolina DSS website that people ARE mandated by law to report suspected abuse and neglect.

She might be half asleep but she looks drugged here? Is it only me?

IIRC there was alcohol in her system at the hospital...I'm thinking she had some of that beer.....evil people....evil:anguish::pullhair::noooo:

Unfortunately the punishment for not reporting the abuse under NCGS 7B-301 (b) is a Class 1 Misdemeanor which would only get JR's mawmaw maximum 45 days community service if she has a clean record :banghead:

It just dawned om me why HR would not let any of Teghan's grandparents watch her while she was out of town. The black eye, the welts, the stories Teghan would tell them...she KNEW she would lose custody and JR could end up in jail. She KNEW Teghan was injured BEFORE she ever left her with JR. And why didn't JR allow Teghan to go into HIS grandparents' house to use the bathroom? Same reason!

She says she didn't let the grandparents watch her because they wanted custody. God knows what else this baby suffered before JR even came into the picture.

OMG this is just all coming together in my head right now. I think Teghan was being abused on a regular basis while HR was still there with her and I think she left Teghan knowing full well that she would continue to be abused while she was gone.

And the state is getting HR to dig her own grave. They have long known what I just figured out, and they are smartly handing her a shovel. They are going to nail her, I have to believe that.

And I wonder if JR is just sitting there quietly, waiting for his turn to get on the stand and mitigate his own responsibility by throwing a few more shovelfuls on. I wonder if he has been told that this could save him from the death penalty.

I don't think that the abuse she received from JR was the first she ever got...I think HR abused her as well-----jmo

This is probably the reason WHY no charges.....by the time an Esquire finished "chatting with the court", she might get probation or even "a letter in her permanent file" (remember that threat from your school days!?)

Unfortunately, it seems that MANY contributors to crimes are often ignored so the courts can get the "big fish" (a certain grandmother's perjury in Fla. comes quickly to mind!)

YEP, :loveyou: thanks :loveyou: to your research Flutterby80, I added that to my first post!!!

Unfortunately, that isn't a universal condition! :please::please: If it were, MAYBE my job might get a bit boring and less challenging!

PS: I'd ADD reporting of elder abuse also! :banghead::banghead:

It's sickening. "All that is required for evil to flourish is for good people to do nothing". The problem is, "good people" is a wildly relative term. Good people don't pretend a child isn't being harmed when they have good reason to believe she is.

she was also using her fear of JR that held her back and of course the possibility that the baby would be taken away.....the later I could understand a bit more if little Teghan was actual kin----but she was a pretty much a stranger ---- I just don't get some folks----and if fearful of grandson---911--they have room in their inn.....

Since when does not being related to a child absolve a person from reporting suspected neglect/abuse of said child on their property?

Is there really no legal responsibility here?

Did the prosecution really NEED grandma to testify against him? They have plenty of evidence to convict him. What did she add of value?

I just got this off of the NC DSS website:

http://www.ncdhhs.gov/dss/cps/about.htm

They HAD to suspect (KNOW) that Teghan was being AT LEAST neglected, with no running water or bathroom of any kind. IMO they should be prosecuted! They could have saved her!!

I'm not sure. I totally agree atleast gma should have been charged with something.

:truce: Just had a fleeting thought: Could HR or the biological father, JS, sue the Creech family's HOME OWNER's insurance?????

OR perhaps a "wrongful death" case against.....(fill in the blanks!)

That would be the icing on the cake of insult to injury of Teghan's memory!

Love this article----they are pretty blunt and honest about HR and how she pretty much up andl left her baby with this monster without giving it a thought!

thank you

Excellent article indeed.

They can't sue the insurance company... they would have to sue the homeowner. However, I can't think of anyone living that should benefit financially from any of this. Everyone failed this little girl.

At this point I don't even care what her reason was. There really is no excuse IMO. I'm more concerned with why she isn't being held accountable.

Sorry. I'm sounding snippy and I don't mean to.

I don't think you sounded snippy, and I agree... everyone failed her, and her being scared is really no excuse. I'm sure nobody ever expects that something like this can happen, literally in their own back yard... being elderly or "country" is not an excuse to let it happen. I'm sure none of us want to think a family member could be capable of such a heinous crime... but at some point you have to take a stand... they could have made an anonymous tip, something... anything. If the authorities had been contacted and that barn searched, little Teghan could have been saved. One phone call could have saved her life. And sadly, these people are going to have to live with knowing that they could have saved her life but sat silent.

I frequently need to take breaks from WS - too much to take in sometimes. Just returned after such a break only to discover Teghan's case. I read here every day now, and will follow to the end for her, but it's just too much.

Breaking for lunch. Back at 1:15pm.

Points addressed on cross exam so far....

She plead not guilty of felony negligent child abuse, could face max 25 months in prison. No priors, would be probably eligible for probation. You are aware court could take into account you testified in this trail. You would inform the court, and hope for leniency.

Never left her overnight with JR prior to leaving her there in July 2010.

Physical abuse between HR and Jerry Skiba. She called police once. Terminated relationship some time later and left. Friction between HR and her mother, and left that situation.

Oh so she left bio dad when things got abusive and left her mother's home when it got rough, but she STAYED with this monster who was abusive to her and her precious child? What is wrong with this woman?
