I have often cited the use of "willful blindness" by NC prosecutors in obtaining both indictments and convictions. This is simply more fruit out of the same putrid bushel basket that Nifong has utilized from day one.

The only black player on the Duke University men's lacrosse team has come forward amid a rape investigation, saying that his three white teammates who have been accused of raping a stripper have been stereotyped by class and skin color.

"It's almost a reversal,'' Devon Sherwood, 19, said in an interview Tuesday morning on ABC's "Good Morning America," adding that it's been assumed by many in Durham that the players' parents are going to just use their money to hire hot-shot lawyers to get them out of their predicament.

"It's just been all the stereotypes... I've even been stereotyped for being rich, being on full scholarship, [being] not in touch with my own black community at Duke... It's terrible to find yourself being stereotyped," Sherwood continued. "And you're like, 'Hold on, this couldn't be much further from the truth … It's just amazing that the things you see and that [were] going on in this case and how the reversal from black stereotype to now rich white, privileged stereotype.''

Article goes on to say that this is what could of caused the scrapes observed on her body and a co-worker also stated that the accuser had problems with other dancers and customers that sometimes caused her problems making money.

Durham County District Attorney Mike Nifong moved Friday to drop rape charges against three Duke University lacrosse players.Nifong's investigator interviewed the woman Thursday, and she told the investigator that she couldn't "testify with certainty" that she was raped.

Prosecutors said they couldn't proceed without her testimony, so they decided to dismiss the rape charges in the case.

Nifong said he plans to proceed with kidnapping and sexual assault charges against the three players.

What the heck? He drops rape charges but still pursues sexual assault? :waitasec:

In order for it to be any type of sexual assault, she has to have NOT consensted to it and told them no. I still do not see how prosecutors have proof that it was not consensual. Who's baby is this stripper carrying? A single mom working as a stripper, pregnant again, she sounds like a first class citizen to me. :banghead:

As we discussed on other threads associated with this case, my belief is that NC prosecutors are the most tenacious in the nation. Fortunately, the case is proceeding as we anticipated.

Nifong seems to finally have adjusted his strategy relating to the absence of DNA evidence linking the suspects to the accuser. Also, the new charges require less evidence. The judge in the upcoming hearing in February may not be as inclined to throw out the charges. Nifong would then get a trial, his goal all along.

Stuart Taylor, a man far more knowledgeable than I, thinks the case will be thrown out. I saw him say this on Court TV and I hope Mr. Taylor is right.

I hope it gets thrown out, too, William. I really believe this "victim" isn't a victim at all, and that the Duke boys are being persecuted.

I honestly don't know what to think about this case. But in NC, rape is defined as vaginal penetration by a penis. The victim is now apparently saying that she can't say for sure that she was penetrated.
