I honestly don't know what to think about this case. But in NC, rape is defined as vaginal penetration by a penis. The victim is now apparently saying that she can't say for sure that she was penetrated.

I heard about this on NPR today and they were saying that there may have been penetration with an object but she can't say for sure it was a penis.

Sports Illustrated's "legal expert," Lester Munson, still supports the case. Munson was mentioned in a previous thread on the case several months ago. At si.com, Munson says in part:

"They still face some serious charges. There is little doubt that something unsavory happened at the party on March 13. After the dismissal of the rape charges, it will be easier for the accused players to attempt to settle everything with a guilty plea on lesser charges. The likelihood of a trial on any of these charges is now greatly reduced."

Plead guilty to what? Where is the evidence that "there is little doubt that something unsavory happened at the party on March 13."

Munson's take on legal action against Nifong is:

"It's possible that the Duke athletes and their attorneys may discuss the possibility of a malicious prosecution lawsuit against Nifong or the accuser. The wiser course would be to drop any such idea and seek a final resolution of the remaining charges."

Munson is what passes for a "legal expert" in Sports Illustrated magazine.

Sally, here's a link that gives a pretty comprehensive overview of the two:

I hope it helps.

Hey, Jeana,

Looks like YOU WERE RIGHT about this case all along!

(Not that I disagreed with you, but I figure saying "you were right" is the best gift I can give. Have a great holiday!

Yours,
Nova)

He sounds like the male version of Wendy Murphy!

I am going to be blunt here. The most unsavory thing at that party was the "victim." I really believe she started this to PUNISH the guys at the party for not giving her more money, and I think she made the whole thing up.

I truly hope these guys do not plead guilty to lessor charges just to make it go away. I am still predicting that ALL charges will be dropped.

At that point, I hope they get together and take legal steps to stop Nifong from ever, ever doing this to anyone else. And I hope they go further and take steps to stop the "victim" from ever "being victimized" again.

The case should be thrown out and Nifong should be prosecuted or at the very least removed from his position. The young men should have their legal fees reimbursed. However, there is nothing that can be done to reestablish their reputations. I also think the so-called dancer should be prosecuted. What a disgusting case and a bad reflection on so-called justice in NC.

I don't know what Duke University can do to reestablish their good name. Recruitment is down, and I feel certain the name will long be associated with this scandal.

I don't really know what to make of this case but I'm at the point now that I think it would be best for everyone involved to throw it out. I don't know what happened at the party or what didn't happen but from the skuttle butt the gal had several guys DNA inside and on her that night. I would hate to try and explain that in court! The defence will eat her alive. Her sidekick has told at least 3 different stories and I get the idea that she...the sidekick... is looking for something out of this whole thing. Whether she could ever be believed is a real question.

From what we have been told Nifong hadn't even questioned the victim until recently. I don't understand that at all. How do you make a case if you haven't interviewed the victim? Has he really not interviewed her until recently? That just doesn't make any sense. He held back info from the defense attorneys? This doesn't sound like a Pros who is on the up and up.
I hope this hasn't all been political and the guys and the victim were just part of the game of getting elected.

If the races were reversed, the girl would be on trial.

Nifong is really in a pickle now. He dug himself in too deep at the beginning of this case, and it is going to come back to haunt him in a big way.

I wonder how much longer he will be on the case, and what will happen to the charges if and when he is replaced?

I don't understand. Do you mean if it was a white girl claiming assault from 3 black men, she would be on trial???

Just a question to everyone on this thread: Is there no way possible at all for these young men to get their reps back? Can't this be expunged from their records? Can't they sue to get it removed? Can they sue for slander??? And how do you not know if you had a penis or another object stuck inside of you? I know the dildos are realistic nowadays but there is still a big difference. No pun intended. If she had so many guys DNA splattered inside her, she should be a pro at telling the difference between an animated and inanimate object.

I also heard on one of the news channels that other attorneys are REALLY pressing him now to let go of the case, or at least turn it over to a special prosecutor.

All I can say about these ethics charges is- what in the world took so long? :banghead:

Duke has invited two of the La Crosse players to return to school in good standing, according to AP reports. The 3rd that was accused had already graduated. Good for Duke!

Presser coming on any time now. Evidently they think these three guys did something inappropriate to her in the bathroom, not rape, but detained her against her will. Has anyone here said she is definately a Ho Ho Ho. Flipping amazing all the money that has been spent on this case.

I think the presser is with the defense attorneys.

Well, it is good for Duke to invite the guys back. But why weren't they already continuing to attend Duke? Were they kicked out just because someone made an accusation against them?

The DNA of SEVERAL men was found inside of her, none of it belonging to the Duke students. "Ho" might just be an applicable term to use for her. Just my opinion.

Hi Kgeaux, Yes, that's why I threw that Ho Ho Ho in there. Trying to be a bit discrete for TOS's sake, but definately thinking this girl was actually worse than that. At least most prostitutes are known for washing and being as clean as possible to avoid disease. This girl evidently wanted to carry all this 'stuff' inside her as a badge of some sort! Scandi
