so, how many of us think GJ will be given the matter of Zahra's case vs how of us think it will just be given the current charges to consider?

With all of the evidence they have collected, it seems something would have to happen soon and wouldn't the GJ hearing be the perfect opportunity for them to present this? (If they have something on her).

Off to take daughter trick or treating for the second time this evening. Good night all.

agree but this isn't TV, they have other cases the lab is doing too. I'm sure they put ahead of the line some evidence but all of it, nope.

As I get my two year old daughter and 8 month old son ready for trick-or-treating all I can think about is beautiful precious Zahra. I wonder what she would have been this year? I know in Oz Halloween isn't such a big thing there. I bet she would have been so excited to be able to go out and get candy with her friends. I can't believe someone would deny such a sweet little girl the right to enjoy life, it just makes me sick. I can't help but think about her all the time and wishing that she was still here. Just seeing how my almost three year old daughter is excited it makes me so sad to know that this little girl who had already endured so much was not given the chance to grow up and become the beautiful woman we all know she would have been. Happy Halloween everyone, and happy Halloween little Zahra - I hope you are smiling where ever you may be sweet girl.

I'm thinking that LE may bring other, unrelated charges forward against EB to motivate her 'cooperation' further, but that's just a guess...

I'm also curious what LE's theory is, such as whether AB, EB or both killed Zahra; and if they don't believe AB was involved in her death, just what his culpability is. :waitasec: MOO

Does NC require a Grand Jury indictment for the charge of murder?

Does this case in particular (given the few specifics that have been reported on) require an indictment by a Grand Jury?

It is standard for NC to require a Grand Jury indictment in order to proceed with a capital murder case?

Just pondering, not arguing LOL. JMHO

ITA but it seems they've had something since they first called this a homicide case. I'm not sure they would need everything back from the lab....just enough to get their point across and charge her.

There are quite a few in the counties I mentioned...not all related though as far as I can tell. I believe there is also a furniture store off from 321 in Hudson or Granite Falls named "Coffey Furniture".

Yep,
Coffee furniture is 5 minutes from my house. Daughter goes to school with a few Coffey's.

No, but in this case Zahra's body hasn't been recovered, so LE would need to rely on other circumstantial/forensic evidence pointing toward a homicide and either AB, EB or both killing her. With EB in jail on other charges, I don't see the rush; unless it's AB they want to indict before he flees. But as far as I know, the GJ may be meeting for another case. MOO

Okay I'm confused. What pregnancy? Who is pregnant or was pregnant? Is this just a theory?

No, just another phoney story EB made up and told AB, which he believed up until the time of her arrest. She had a hysterectomy years prior, so no way that was going to happen.

I wish LE would give a presser, some news any new news on Zahra.
Not knowing anything is so hard to slueth.
We only know that Zahra is a homecide case.
Now who? SM? AB? Both or another also.
Where is Zahra?
Is LE still searching for her? evidence?
OR is everything done now.
Are we waiting for arrests now?
It seems so closed up by LE.

but as noted by another poster on another thread, once they bring the charge, the ball starts to roll. If they do not have all the evidence from the lab you can bet your sweet bippie that the defense attorney's will rush for a speedy trial.

Amen to that!

O/T I have to share
Would you believe there is a woman just like EB in our town and her maiden name is Baker..........no lie and she was pregnant with twins and had a hysterectomy. And she was age 55 at the time.
Uses men for money, (from here to Vegas) how dumb men can be.
lies like a rug.............
she is on SSI for being mental and can't hold a job.
Whole family are thieves also.

as I read this it just makes me crazy..............
I have met evil in person........thank GOD she never murdered YET!!!

As of Friday they where still searching for her. Last night I posted an article where they explain that they expanded the search around the area where the leg was found in the hopes of finding her remains. So as of Friday at least they where still looking for her. I think that will continue but that's just my guess. They seem pretty dedicated.

A couple of references I found about NC law and grand jury and other stuff I guess.

Read if you want. If not just ignore.

Posting in case this does go to trial so we can understand how NC works.

NOTE:Page 2 Line 25

All SPECULATION

Still wondering why Dubs was provisionally assigned. I don't buy at this time that she went to evaluate whether the defendent EB was indigent.

Because there is a form that can be filled out and submitted in the case of indigency that can be used to evalute.

LE has only called this a Homicide. They have not (to my recollection) stated which charge under the Homicide NC statute that might be brought forth.

On the second PDF page 2 line 25 it states:

The willful, deliberate, and premeditated killing of a person under the
24 age of 14 by a person age 21 or older.

Can or might qualify this as a capital case if willful, deliberte and premeditation can be proven by the evidence.

I can't speculate as to which charge LE wants to bring forth but since Dubs has been provisionally assigned makes me wonder if this is where it might be headed KWIM?

Interesting is all. JMHO.

So there was burnt samples inside the Tahoe?

The Tahoe being found stinking of gas with burn material inside reminds me of a case I saw recently. A man killed a woman, put her in her car, doused the inside with gas and ran. The car was caught on video from a business nearby. It showed the fire inside got really bright, almost like an explosion but it quickly went out. He did not leave a window cracked or a door open which robbed the fire of oxygen so it only lasted a few seconds.

It was found by LE who noticed a strong smell of gas and a small amount of burn material inside. The car was pretty much intact. Even though it was doused with gas, the fire used the little amount of oxygen and quickly went out.

So the way the Tahoe was found makes me think it's possible they tried to burn it as well but didn't leave a window open to feed the fire and it never fully went off.

Maybe then they decided to put the note inside (take out whatever they where trying to burn) and leave the door open so LE would find it. If the dogs hit on the Tahoe for decomp that gives me an even clearer picture of what they where trying to burn.

Thought provoking.

Re: grand jury.... what does State have to present so far (that we know of)?

- Fake ransom note + EB admission that she wrote the note to throw off investigators
- Tapes of 911 calls
- Evidence from initial search of house and 10/27-28 searches (incl pieces of walls, large grey tarp, and unidentified small bits from yard--but no time for lab testing of same)
- Mattress from home
- Prosthetic leg
- Witnesses of varying reliability to EB's abuse of Zahra
- What else?

Am leaving out glove found in yard, mattress at landfill... But if this is all DA has then yes it would be super risky to go before grand jury yet...

ETA: Thanks Kat! GJ nerd here. I will try to become a home-schooled expert with you.

ETAA: Looks like in NC capital cases all require premeditation. Based on what we have seen thus far that might be hard to prove.

My humble opinion is there is a little politics going on. EB's attorney probably is defending her on the other charges as of now, but she isn't a dummy. This is a high profile case, and she expects there will be a murder charge. She could careless about the money but did this to start the ball rolling. Once she is the attorney (her office) on these lesser charges, once murder charge comes in she will petition the court to remain her public defender being she is already involved with the defendant.

That is a good thought. Hmm.. I keep getting caught on the fact that they doused the Tahoe in gas though. Was the pillow, blankets and stuff also found inside the Tahoe?

If they tried burning Z and the evidence inside the Tahoe and it didn't work out I guess they would put her inside the car to take her someplace else. They can't drive a truck doused in gas. That could explain why there are hits from the dogs on both cars? Plan A failed so onto the car for plan B.

Waiting to find out what really happened in this case is like digging in the box for a cracker jack prize. You don't know what you are going to get, you just know it's going to be disappointing. :(

Also very thought provoking. I never could get a handle on why the pillow and comfortor were in the work vehicle, or why cadavers would hit on 2 separate vehicles. This would certainly explain those 2 things.
