I know he is entitled to an adequate defense, I understand that. Does anyone ever think about what all this does to his victims' families?

No, and they shouldn't. As cold as that sounds, I believe it's considered a crime against the state and not against the individual victim. The system wouldn't work if we allow the sympathy for the victim (or lack of sympathy) come into a trial. That's why they don't allow a lot of crime scene photo's.

Things are screwed up enough in many trials with innocent people getting convicted.

I think it's a vigorous defense, not an adequate one. What are considered adequate by one judge are ones that get thrown out by supreme courts as have a bad lawyer.

I realize how upsetting this is for families, but wouldn't it be more upsetting if the killer goes free or the wrong man gets convicted.

I live in Omaha and these crimes were horrible, especially the little boy. I can't believe they would want a change of venue - he's more likely to convince a jury in Omaha that he's crazy - I don't think he wants to take his chances on moving to a rural community. Personally I think he's going to get the death sentence.

If he had local legal representation they'd realize he would get a better chance of cheating the death penalty with a local jury. These attorneys are from the Chicago area and apparently do not understand that a jury composed of folks from a rural or small town Nebraska area would be far less receptive to be swayed by their tortured arguments.

I have lived in Omaha most of my life- I have followed local criminal cases most of that time. I cannot recall one instance in all this time of defense attorneys utilizing a survey company to gauge public opinion. They have to be spending tens of thousands on this. Garcia's family as i understand things, are not all that well off. Who's paying for all this? Or are they counting on this getting them free publicity and getting more legal business down the line?
It has now been seven years since these murders. Enough already.

Garcia's attorneys' efforts to get a change in venue and sequestration have been tossed. I sense that the local courts are getting tired of all the defense games. I assume this may mean it goes to trial later this year.

The Montis' (defense attorneys) have hinted over the past months that they will allege Garcia is innocent and that some as yet unspecified dark plot was taking place at CU, that Dr Brumbach was keeping Dr Hunter under surveillance for something. I'd bet they will drag in Belinsky before they are through.

Nebraska's Unicameral has a bill to get rid of the death sentence.

They do this every year, and some years they get very close.

It's put forward by Sen. Ernie Chambers (who had some national attention when he declared that if he owned a gun and a police officer approached him he would shoot first and ask questions later - He also once sued God)

Nebraska passed a bill in 2000 which limited our representative to two terms in office (It was known as the Ernie Chambers bill) Everyone knew it was a deliberate bill to get him out of office. (I voted against it - if people want to vote someone into office, that's their right - even if I think he's a nut). He waited out the time limit and was elected again.

In case you don't know Nebraska is the only state whose legislation is a Unicameral - we only have one house and they don't run by their party affiliation - so you don't know if they're Republican or Democrat or Libertarian.

This bill would also re-sentence the current death row inmates, which includes:

Nikko Jenkins - who went on a killing spree and killed 4 people in 2013. (One of his murders happened 6 blocks west of my work on the same street during the time I was getting off work - Fortunately, I go East to get home).

Carey Dean Moore - who killed two taxi drivers in 1979. (I remember this so well, as my father was driving a taxi part time at night)

Michael Ryan - who killed James Thimm in 1985 - (he was white supremacist whose torture killing of Mr. Thimm is unbelievably horrible - and too gross to put on this board - if you want to know what happened, it is on the internet) He had also killed 5 year old Luke Stice - but is not on death row for that killing.

John Lotter - killed Teena Brandon, Lisa Lambert & Philip DeVine - in 1993 - (This is probably Nebraska's most famous murder - This is the crime that was made into the movie "Boys Don't Cry - Hilary Swank won an academy award for playing Teena Brandon).

David Dunster - killed his cellmate Larry Witt in 1997.

Raymond Mata - killed and dismembered 3 year old Adam Gomez in 1999.

Arthur Lee Gales - raped and murdered 13 year old Latara Chandler and then drowned her 7 year old brother Tramar.

Jorge Galindo, Jose Sandoval and Eric Vela - who robbed a bank in Norfolk and killed the 5 people inside the bank in 2002.

Jeffrey Hessler - who murdered newspaper carrier Heather Gerrero in 2003.

Roy Ellis - who killed 12 year old Amber Harris in 2005.

Marco Torres - who killed Timothy Donohue and Edward Hall in 2007.

I doubt if any of these people - killer or especially the victims will be brought up in the debate.

The Montis are now asking for two separate trials, one on each murder. Guess that would double their fees, no??

I fully expect to be sitting here five years from now while these attorneys pull one thing after another out of the hat. The courts need to end this stuff, force a trial and get a result- if a conviction they can do all this as appeals. At least the families will have it behind them. Good grief!

I thought he looked down-right happy in one of the recent pictures.

Yeah he thinks he's gonna just walk out when this is all over, then sue the prosecutors, news media and everyone else he can think of with the help of these attorneys. Then maybe write a book and sell movie rights. Yes, he's that stupid. The couple defending him have him convinced of this. Have to wonder if they really think he's not guilty.

Hi Snick and everyone. I'm so glad to see that this case is moving along. I'm not very concerned with AG being found not guilty. The defense team and their experts best not insult the intelligence of jurors. AG looks just like the composite sketch from the witnesses in the Hunter/Sherman case, especially since he's lost the alcohol bloat, and it's hard to argue with the gun and DNA evidence that was likely left behind at the Brumback home.

AG is a narcissitic sociopath and a killer IMO. Smirk away AG, child killers aren't very well received where you're going!

And the death penalty was voted out in Nebraska by the Unicameral - they then over rode Governor Ricketts Veto.

The people are able to start a petition to stop the bill and put the law to a vote of the people currently about 70% favor the death penalty.

Don't you love it when your elected representatives just completely ignore the will of the people.

If the petition fails - he will not get the death penalty, nor will any of the ones I listed in an earlier post.

Although this guy passed away on May 24

And if you think things couldn't be worse - I just found out a few weeks ago that the guy below not only dismembered a 3 year old - but the police had found parts of the body in his dogs bowl.

Wit utmost respect I have to let you know we disagree on the death penalty. I really don't want to debate it with anyone- it is one of those issues that decent people can disagree on and still remain friends.

I also don' t want this to become a debate over the death penalty - my main issue is a legislature, many members who ran on retaining the death penalty and then voted to get rid of it, when 70% of the people in their state are are in favor of it.

The list was mainly to show who else was on death row here and if you're going to have a death penalty these people should all certainly qualify, as I don't think there is an issue of guilt with any of them.

Does anyone know where (as specific as possible) Anthony Garcia was living in June of 2001, when he was fired from Creighton?
Also, does anyone know what day he was fired in June of 2001? Or when his appeal was denied?

Are you looking for a possible tie-in to another crime? Sorry I don't have the information you are looking for. Someone else on here might.

Dispicable!!!

Sure is. This is one of the worst cases of witness intimidation I have ever heard of. If these attorneys get taken off the case everything is back to square one and any trial is that much further away.
