I may well be wrong but I don't think TES has a paper trail to indicate which volunteers worked in which area. The volunteers' forms were compared to their identification, signed and collected at a central table. Then they were instructed to stand in groups in designated areas. The Team Leaders were told to go to a group and take them to the areas that had been assigned to them (the Team Leaders). I doubt that many, if any, of the Team Leaders remember the names of the people in their group. There was no paperwork created to indicate which group anyone was assigned to.

I'm not criticizing this ~ I'm just trying to explain that I don't think the paper trail that the defense team is hoping for even exists. I don't think there is any way (other than the volunteers coming forward) to identify who searched where except the Team Leaders.

This motion, if granted, seems like it would only bring frustration and grief to all parties involved and advantage to none. :cow:

When the TL returns to the command center they do a briefing of the assigned area which they were instructed to search according to the mapping.

Once the team returns to the Command Center, the process is done over and over the same way each time a team goes out and returns.

One thing for sure, Tim is up against pure evil here. I know he will win out in the end, and in doing so, I hope he gets the chance to tell Casey and Baez how a person truly acts when their child is missing. I hope he tells them his story because no doubt his heart will pour for his child.
While Caylee is an angel in heaven, Tim is our Angel on earth, and good will win over evil.
This is a battle Baez should have never taken on. Had Casey told the truth, Tim would have never had to be involved.

Did the Team Leaders turn their list of names in to TES when they returned from each search, then? I wonder how long TES keeps all this paperwork.

It is very important to establish if any searcher had looked in that area to establish if the bag was there when they searched.

Why do you all want people to withold evidence or make it difficult to find out the truth? It is only your opinion whether or not Casey knew that body was there.

If it was seen but wasn't looked in, then so be it. At least it would prove it was there! I am sure there were bags people did not look in or see on the searches for one reason or another. You ALL should want to find out the truth!

Do you want the jury to have a doubt that the bag was there because Tim is mad and doesn't want to aid in the defense at all? If that comes out during the trial it will only help Casey. IMHO this is a game that may backfire on the prosecution.

Think about it!

I don't have to think any further than the autopsy report that states the vegetative growth is evidence............consistant with her being their since JUNE 2008. I rest my case

Maybe, just maybe Baez could have asked Tim personally about what areas was searched, when and what the findings were. And just maybe Tim would have shared that information with him because he is a good man! But noooo, Baez had to go filing motions, jumping the gun!
All along I said, Baez is not looking for a court fight, he is looking for a street fight when it comes to the integrity of TES and the searchers who volunteer their time!

Maybe, just maybe JB is looking to throw a TES searcher under the bus concerning some evidence found in the vicinity where Caylee was found! ????

I don't think anyone has said he should give them all the volunteer's details....I think it highly unlikely he would get it, and as I've said before I admire TM for taking a stance on it and I do think it's great that MN is volunteering for such a fantastic organization. I really don't think JB will continue to press to get all their details, and will try to narrow what he is asking for, but I may be wrong.

Of course MN doesn't have to teach Baez anything...they are adversaries now, though a few months ago it was a different story! But, what if JB just backs away from it, then 6 months after Casey is put to death or simply convicted, a searcher comes forward and says he was there in August and the body wasn't there? MN has a good argument, but I think the Court will want to ensure the Accused gets a fair trial, and that will also weigh into the court's considerations. JB has to make sure he knows as much as he can about the state of the site at relevant times...it would be negligent for him not to make those inquiries.....but that doesn't mean I agree he's entitled to all the personal details of the volunteers.

Anyhow, we'll have our answers soon....live, thanks to the internet!

There is NO WAY a searcher would be credible saying such a thing, since the EVIDENCE shows that it WAS THERE since June 2008.

Agreed. Nejame mopped the floor with baez already the first time he had to address this, and now it is just plain humiliating for Baez, it really shows him to be such a novice!

The defense sees a possible way to create reasonable doubt. I can't really blame them for wanting to see if anyone credible could say the area was searched.Frankly I think TM will be a witness for the prosecution.We know JW's testimony won't hold up for the defense.Won't go into her now,but JB is hoping there's someone he can use besides her.
The defense has had a contentious relationship with LE and the A's had a contentious relationship with TM ,so the motion comes across as a gotcha.I think there may be something the defense is entitled to but not the whole ,dang thing!

IIRC TES had been in the area, and it was flooded, they could not do a ground search on foot due to high water. Caylee was under that water. I mean how stupid is the defense. TM gets on the stand and states exactly that.
The baby was probably decomposing under 3 feet of water ladies and gentlemen, in as much as I would have loved to have found her and brought her home, her Mother threw her into a low lying flood plane that did in fact flood and no one could get to her until it dried out. Is that what the defense wants to play out on the stand under oath?

God help JB if this ridiculous motion is granted and he ever has a family member come up missing. He'll find himself very lonely on his search.

But anyway why doesn't JB just ask TES if their records show that JG, RM, AH, ZG or anyone else they've accused was part of any search team? I mean thats what they are looking for, we all know it, just someone, anyone to cast suspicion on. Please, he is soo transparent. And desperate. JMO

Problem is, spaghetti only sticks if it's al dente.

None of JB's noodles are properly prepared. Nor are they made with quality ingredients. They're just flour and water.

...And the taxpayers get to ultimately pay to pick up the fallen spaghetti...This may not play well if it can be slyly incorporated by the state-The defense and the defendant have wasted the court's and THE PEOPLE'S time and money.

I think we had also speculated that one of the original reasons JB wanted to get his hands on TES records is that Hoover had signed up as a search volunteer and begged the people he registered with not to mention he signed up or he would "lose his job" (which is interesting, since he has insisted he was a volunteer to "help" with security, and it doesn't look like either he or DC was actually paid by anyone they "contracted" with.

So there might be more than one reason, other than simply a "fishing expedition" (though that is perfectly reasonable given these people and their tactics).

Sure hope this one is also denied. The Sunshine Law is becoming covered with Clouds.

This brings back a memory of CA stating that Hoover didn't work for them---was that in the Morgan depo? Where ever it was she seemed to be making a loud point of stating it.

I admire your belief that it is relevant to the defense of Casey, but if TES had gone in there with horses, or buggies or ATVs they would have pulverized the evidence. And what a mess that would have been-what might be more relevant is what is TES' best practice for similar situations-do they charge into the low lying flood plain praying they find the body before they grind it into the mud and therefore this situation was somehow treated differently, or do they wait for waters to recede and then complete their search....jmo.

I'm not sure I understand your post as my post is not relevant to the Defense of KC but to the contrary, THE PRosecution of KC. I think the defense are playing a wild and wreckless game with TM as this man and his work will defend itself. TM has stated on many occasion, if there is an instance where horses or atvs could cause more harm, as in this specific scenario, they back off, they wait and then return when conditions are right and the safety of volunteers are not in question.
