I'm here in the Netherlands at the moment. There are such lovely people here. It is just making me think of all the work the Dutch have done to identify and get the MH17 passengers back to their loved ones. And their refusal to give up, despite all the difficulties.

At one stage I doubted even a single victim would be returned. Now look where we are, thanks to so many people's love and dedication. Such a contrast to the careless cruelty of the people who shot these passengers and crew out of the skies.

Relatives of three German victims of MH17 sue Ukraine before the European Court of Human Rights.

They are convinced that the country was partly to blame for the crash of flight MH17 from Malaysia Airlines.

Ukraine is charged with negligent homicide in 298 cases, according to the German newspaper Bild. Their lawyer said that the airspace was open despite the war.

"The role of the Russians is not clear at this time," lawyer Elmar Giemulla who assists the three families, said. "But it is clear that Ukraine was not able to guarantee that their airspace was safe."

"According to international law, any country that allows international flights is responsible for the safety of the airspace over their territory. Ukraine has failed to close the airspace," said Giemulla. The crashed aircraft had 298 passengers on board, four of whom were German.

The relatives are planning to submit the charges against the Ukrainian government and President Petro Poroshenko within two weeks. In addition to compensation for material damages the lawyer demands indemnity as well. He starts from a sum of at least € 1 million per victim.

Malaysia Airlines has paid the relatives a deposit of 5000 euros for compensation. The rest of the money will follow.

Dutch Criminal Lawyer Geert Jan Knoops told RTL Nieuws that taking the matter to the European Court 'is a challenge in legal terms.'

"I can understand them, because what do these people have to lose? However, you can only submit a complaint to the European Court after the citizen in question has completed the national judicial process. Now one can not say that situation in Ukraine is so poor yet that this is not possible. The lawyer can make an attempt but it's a legal challenge. Another possibility is that this lawyer refers to a kind of temporary ruling of the European Court. "

The likelihood of two different Buks having the same markings and also the same damage seems incredibly unlikely, so this shows that the Buk photographed in Ukraine, travelling through rebel held territory on July 17th, was the same one identified inside Russia in a convoy containing vehicles from the Russian’s 53rd Zrbr “Buk” Brigade based in Kursk.

This weekend, the leaders of the MH17 investigation team returned empty-handed to The Netherlands. The disaster area was not accessible for investigation, due to military clashes between the Ukranian army and the separatists.

Twenty members of the team remain In Ukraine and are ready to travel to the disaster area of the downed aircraft as soon as it is safe.
The team wants to go to the crash site to recover all the personal belongings of deceased passengers and to do further investigations into the cause of the plane crash.

'I am optimistic, but also realistic about the investigation of MH17. Late October, mid-November winter will start, and then investigating is no longer possible,' Aalbersberg says.

Aalbersberg will travel back to Kiev on Sunday evening. 'We have to keep the pressure on and continue negotiations. It should be clear that the Dutch government will do everything to get the truth on the table.'

Australia, which is hosting the gathering, said on Saturday it was the “emphatic” wish of member nations that the Russian president attend.

As the G20’s rotating president, Australia has been canvassing the views of other member nations about what to do. Despite Western concern about Moscow’s territorial ambitions, the Australian treasurer, Joe Hockey, said the consensus was that Russia should attend the leaders’ summit to help address the geo-political tensions.

“So there was a view that the door should always remain open to keep the dialogue going because ultimately that will be the best way to alleviate some of the geo-political challenges that are faced by many countries by Russia’s actions, and others’ actions, over the last few months.”

Malaysia evidently has three people who never made out of the crash site :(

Prime Minister Datuk Seri Najib Razak today reaffirmed Malaysia’s commitment to bring home the remains of the last three Malaysian victims of the Malaysia Airlines (MAS) Flight MH17 tragedy.

“We will continue our efforts to bring home the remains of the last three Malaysians and gather forensic evidence from the MH17 (crash) site,” he said on his Twitter account today.

I am not sure that that is what he means. Not all remains have been identified yet, and the last three Malaysians may well be among them.

Let's keep our fingers crossed that they are! and that all passengers and crew can be accounted for.

251 VICTIMS IDENTIFIED - 26 NEW IDENTIFICATIONS

But the reality is different. Today, the Ukranian army and the separatists were fighting near the airport of Donetsk, and it seems that for now, the separatists are winning.

Malaysia is to leave it to the Dutch and Australian authorities to determine when personnel can be sent to eastern Ukraine to retrieve any more remains of the Malaysia Airlines (MAS) Flight MH17 tragedy, Defence Minister Datuk Seri Hishammuddin Tun Hussein said Friday.

He said the decision was left to the two countries as their nationals comprised a large number of the passengers on board the ill-fated Boeing 777-200 aircraft which was shot down over Ukraine on July 17.

Malaysia will continue with its probe into the MH17 tragedy from the technical and criminal aspects and hopes to obtain sound evidence to bring the criminals to the international court.

Since fighting broke out in mid-April at least 3,000 people have been killed in eastern Ukraine and up to one million people displaced.

A ceasefire was agreed as part of a peace deal signed in Minsk on September 5, but violations have been reportedly almost daily since it was signed. Until recently much of the fighting was contained to the area surrounding Donetsk airport, where pro-Russian separatists are trying to drive Ukrainian forces from their last foothold in the city, and other flash points near the frontlines such as Debaltseve and Popasna. But overspills in the clashes and civilian casualties have mounted notably in recent days. On Wednesday at least nine deaths were reported after shells hit a bus and school playground in the Kyivskiy district in north Donetsk, close to the airport.

Investigations at the MH17 crash site in eastern Ukraine have been ceased temporarily hampered due to bad weather, and will resume in April, next year.

Inspector General of Police Tan Sri Khalid Abu Bakar said the area is being guarded by the Ukrainian authorities after Malaysia, Australia and the Netherlands deferred the investigations.

He added the Ukranian authorities have asked the residents in the nearby areas to return victims' belongings to assist the investigations.
