NEw Search Warrant Tonight. Dec.4th, 2007

If this warrant is really just an expanded search of the cars - I wonder if that means that they needed it to maybe get the GPS data from the automaker? Someone over at Gretawire was commenting that the Denali has GPS on it, even if he never signed up for OnStar. I had forgotten that about newer cars - they have these "black boxes" in them that tracks all this stuff and it can be used against you if you get into an accident, etc. They can access the data in the black box and determine speed, braking, etc. in addition to the GPS data.

Maybe LE is getting closer to an arrest.

But they already have the Denali, so why would they need to go back there?

Could they have found blood in one of the vehicles and want to check the garage for blood?

I'm not understanding this either. Like you all have said they already had a search warrant for his vehical and LE still has the vehical so why another search warrant?

We'll have to wait for Greta in 7 minutes - but I don't think they went into either the house or the garage. I think they just delivered papers to him notifying him of an expanded search on the cars.

It's JMO, but I don't think this new warrant has anything to do with the motion Brodsky filed; they had to have some new information to get another warrant. Brodsky can complain all he wants, but LE can keep the cars until they want to give them back. IIRC, Modesto PD kept Scott Peterson's truck for a really long time.

State police served another search warrant at the disgraced former cop’s home — the fourth since his young wife Stacy disappeared Oct. 28.

“It expands the scope of the initial search warrant, specifically with regard to the vehicles,” Charles B. Pelkie, spokesman for State’s Attorney James Glasgow, said of the search warrant dropped on Peterson on Tuesday night.

I don't know how they can tell who was driving it when it left, unless someone saw it leave. I'm guessing that it wasn't Stacy, since it just happened to leave while Sharon, the neighbor/good friend, was gone. What a coincidence.

Ohh.I can't wait to hear what they were going back in for. Drew is at the house while they are there.The prosecutors to determine if Peterson should be charged with misconduct.

To determine?? Of course he should be charged.

I can list a few things he has already admitted to doing starting from his blatant misuse of his status as a police officer back in 2004 when he broke into KPs home the night she was found. There was no call to the BPD for a well-being check on Kathleen Savio. He was no longer a family member and didn't have the right to enter her home.

Go back further to when he was on duty, sitting around the lobby of the local hotel, keeping a 16 yr old girl company. The tax paying citizens of Bolingbrook pay his salary. Is that what they paid him to do??

Using confidential databases for personal use

Using a government vehicle to conduct personal business. Didn't he say he was dropping off the kids to KS, then he said he was the on-duty watch commander the night she died.

Then there's his issue with befriending drug dealers. I doubt there was just that one time.

If he did any type of "surveillance" of Scott Rossetto or Stacy's other friends that could be considered stalking I'd believe.

As far as the search warrant. I am very curious.

They could want to see the contents of that safe DP said Stacy took the $25,000 from. I doubt the money ever existed but it's possible since he was walking on both sides of the law. Drug money often gets the residue or scent of the drugs on it.

Ok, I have been thinking about the warrant. When they write a warrant they have to write specifically what they are looking for. Say fingerprints, DNA, blood etc.
Ok, they have the autos and they said in court they are still processing that. So while they were examining the vehicle, maybe they saw something like fibers, soil samples, etc and let's say they saw some soil, but it isn't covered on the warrant. Would they have to reapply for a new warrant?

If used in the commission of a felony, LE can seize them and file for forfieture. Then use them or sell them and use the proceeds.

I believe the warrant specified addition search for blue shavings or fibers, ring or impression on carpet where something has been. I can't remember what else.
