Hey gang! Just caught this trial live streaming but I have a question. Initially I thought the State was going for Murder 1 but recently I thought I read that the State is now seeking Murder 2?

I gotta say I am not over the moon with the State's attorney. I thought I heard the Judge actually ask the State if they were going to object at one point???

I'm not going to be able to help---I was thinking initially Murder 2 then upgraded to Murder 1......

Seth Mazzaglia, 31, is charged with first-degree murder in the death of Lizzi Marriott. Friends of Marriott's packed the courtroom and heard graphic, troubling and conflicting stories of how she died.

In opening statements, prosecutors said Mazzaglia choked Marriott with a rope and raped her when she denied his sexual advances. But defense attorneys said it was Mazzaglia's girlfriend, Kat McDonough, who caused Marriott's death.

Just quoting my own post to show the 1st degree murder charge.

I'm going to take a stab at it and say the girlfriend of SM spilled alot more than the police had originally known. Guess we'll find out when she is on the stand.

What else does the State have? Wasn't the confession and hours of interrogation thrown out by the court? No body recovered? Some minute hair/DNA showing victim had been at that cliff.

I was watching the testimony yesterday and had a great time hearing the defendant's texts or emails to his gf saying how wonderful he was, how powerful and an all around chief poobah.

Then the camera went to the defense's table and I thought I was looking at the pillsbury dough boy with a beard to disguise himself. Is he serious?

Thanks, I prefer wmur's stream over WAT's because you can just click the on/off button when it goes off (every 15 minutes) instead of having to refresh the whole page, but when they turn the stream off for breaks the wheel constantly tries to get the stream and there's no way to stop it without closing the whole page. 6 of one, a half dozen of another. lol

Hi CCH, from what I can read around the internez SM is charged with 1st and 2nd degree murder. I guess it's up to the jury to decide?

The state's attorney is pretty dry, not passionate like Juan Martinez. He seems young to me -- in fact everyone in the courtroom excepting the judge seem young to me.

State's attorney blurted out a question to interrupt defense's cross examination of a witness and the judge asked, "Are you objecting?" He's said that several times, in fact.

Besides the folding tables (used to play cards on) the furniture in this court looks like something I would throw together.

Is this being televised from someone's basement?

I think you're right about the age on both sides. Attorneys ask to approach the bench instead of objecting and letting the viewing audience hear it. Maybe neither side isn't very confidant about the law?

this line of questioning is starting to annoy me...discussions aren't always arguments

Somebody palease tell the witness to quit the dry sniffles.

The bench looks like a stage prop seen from the back. The projection device for displaying evidence is probably on an electric winch, but it looks like it could be in a classroom. The door to the left of the judge looks like the fire door in the back of a restaurant.

Despite the oddly temporary setting, some serious business going on here...

Could be that the defense's strategy is to smear, I mean paint, everyone on the State's witness list as liars, thieves and general all around scoundrels?

Probably lack of confidence and maybe lack of experience with some of this subject matter -- bisexuality, BDSM, role-playing video games, sexual sharing and jealousy.

Neither side seems to really "get" the tone of their text-messages, their sarcastic, silly humor, their loose relationships. Could it have been a terrible accident during consensual sex and really really stupid decisions afterward?

I wanna know. Are they projecting stuff with a microfiche? What an austere room? Wonder what their jails look like :escape: no electricity and a bucket in the corner?

I have to believe that it takes a few minutes to strangle the life out of someone? That moment of climax that the defendant says happened must have lasted for several minutes? How can that be accidental? I can see snapping someone's neck (if you are that strong) in a second but strangulation takes much longer.

I don't see how it could be accidently unless we are dealing with a very low functioning person?
