Judge is going to instruct jury then send them to lunch. State will move on to the night of the killing w/Gerkin after lunch. #SethMazzaglia

Judge.... no prosecutorial negligence... re jury direction... he will instruct them to set aside, ignore, her statement, as evidence, and he has no reason to believe they won't follow that instruction. He's listened to Gerkin's responses... he's not going to permit leading the witnesses or open-ended questions to avoid a similar issue. He will ask to strike last two questions.

Judge to jury: I'm going to ask you to go back to two events... a question posed by Atty Ward and then an objection, I'm striking the question and answer both, there was another question and answer, I am reiterating that the first q&a remains stricken, the second is stricken. When I strike something it does not exist. It means evidence is not competent or admissible.

Unhearing something I just heard would be near impossible for me. I would think as the trial proceeds so much more will be heard and seen that maybe recalling this witness's answers will fade? IMO she doesn't have both feet on the ground so what importance was initially given by the jury to this woman's testimony?

BBM: interesting way to state it...never heard it expressed quite that way. I think the defense atty would agree. Interesting character

True, and the fact that she's a psychic/tarot card reader already wouldn't lend a good starting point of credibility among many folks. I think the judge was correct in curtailling open-ended questions, esp. with a witness such as herself who hears and sees things 'regular' people do not.

I understand that neither side wants to 'prep' a witness to the point that it sounds like the person is parroting back what they have been memorizing but in the case of that witness? Unfortunately she is the one who saw the victim's face after death.

Imagine that between the man that accompanied her to the apt that night and her she was the stronger witness of the two?? Wow, I can only imagine this guy... Could be he is the individual on the bottom of that psychic link popsicle provided?

Iirc Kat invited Her & a male over to the apartment to ask them "what to do." R saw LM dead, blue in the face, with a plastic or paper bag (or both) on her head. R cut the bag open to have a look see.

I believe one plan of SM & KM was to pin the murder on these other two bright lights.

hehehe, I got my supplies at hand for that! Do you think we will get to her today? I have a feeling the current witness could still come up with a few more 'bombshells'.
