Barth references the letters Seth sent Kat from prison... he calls them fantastical ... and the jury has to decide whether they show his guilt, or his ongoing efforts to protect Kat.

If it is all true what Barth says about Kat and it was all her fault. Why didn't SM throw Kat under the bus and do the same thing Kat did and go for immunity and talk to the GJ.

Totally made sense... but it seems like Barth is basically saying that the blame for LM's death lies with KM and LM. No blame for SM.
