To convict Mazzaglia on the conspiracy to commit tampering with a witness and informants charge, the state must have proven during the course of trial that Mazzaglia agreed with another person to commit said tampering with the purpose of hampering an investigation. An overt act must have been taken in furtherance of that conspiracy. The indictment listed a number of instances where Mazzaglia may have tampered with witnesses.
