According to court records, Mazzaglia confessed to police that he “flipped Elizabeth's body over the fence and it landed on the ground on the other side.”

“He stated that he then threw her body off a small cliff into the water,” according to an affidavit for his arrest. “Mazzaglia stated he recalled hearing the water splash.”

After viewing the Peirce Island scene, the jurors were then bussed to the Residence Inn at the Pease Tradeport where they were shown a fenced-in Dumpster in a back corner. It's there, according to prosecutors, that Mazzaglia disposed of a tarp used to move Marriott's body, as well as trash bags “that he had attempted to cover Elizabeth's body with.”

The jurors were lastly brought to a University of New Hampshire horse barn, where they were told McDonough dumped “some of Elizabeth's belongings.”

Mazzaglia laid out an elaborate three- and seven-day “delay plan.” On separate sheets of paper, he used graphic and lewd descriptions to explain to McDonough what she needed to do next.
During the first ritual, she was supposed to wear skinny jeans, no bra and shoes that slip off easily. Then she was supposed to seduce her brother, Ben, into having sex with her.
In the second equally disturbing ritual, McDonough was expected to go to a frat house and find 10 college aged men who were smoking cigarettes and drinking beer. After dropping her skirt she was supposed to give each student “as many turns as each one wants.”
McDonough said she was to perform these graphic acts “to gather energy or something like that.”
“Did you do anything?” Hinckley asked McDonough about the instructions she received.
“No,” McDonough replied.

I think if Seth testifies, there's a real good chance he will walk. All he has to do is blame Kat and she's already proven to the jury that she's a liar. There's his reasonable doubt, right there. Of course, that depends on what the other evidence shows that we have not seen yet.

Wow, it would be great to hear his story but IMHO he won't testify and for sure he is Guilty, guilty guilty...
There's plenty of physical evidence that corroborate the account of events.
It's just a matter of deciding between 1st and 2nd degree murder, do you believe it was an accident? or was it premeditated murder?

Totally respect your opinion, but I think the exact opposite would happen. If he were to testify I think the pros would eat him alive.

As of right now, I am of the opinion that he won't though.

that could be so very true...once Kat gets off the stand I am hopeful some sanity will return...that someone will be talking about things that are real not pretend...that people will just be themselves not playing roles and that some truth can be heard. This trial has been very side tracked and time to get it back on track.

I agree there is little likelihood that SM will testify. IMO the "story" that is being woven to contradict KM's assertions of the "truth" is Barth's story, not SM's. I don't think that SM can tell it, on the stand or otherwise.

SM gave his jail cell roommate his debit card for goodness sake.

Hi first post - I apologize for form errors. I have been lurking here since November 2012.

I cant find the archive or remember exactly the Def lawyers statements that led to the missing hour. I remember the 30 min poker and the 10 min strangulation and think there was also a 15 time for something else. Based on this the Def missing hour assumes that at 8:51 they were instantly playing poker till 9:21 and 10 minutes of strangulation from 10:37 to 10:47) leaving 9:21 - 10:37 with the unremembered 15 minutes and the missing one hour and 1 minute. The big question - are there reasonable things that make up that hour - especially given the fixed times that are provided. Pros listed out some assumptions in his explanation on Re-direct. Basing on that and adding detail I come up with this

How to explain the Neigbors screen approx 10:45 vs calls to RG at 10:46. 10 min strangulation would have to start 10:36. Assume teh approximate estimate was off by 7 minutes.

While Barth does say they told her they could not help her, he also has her admit/explain that Seth was still in the process of choosing an attorney at that time, there was a phone call or some communication he mentions that proves he wasn't Seth's attorney then.

Yes, I believe you are right that a final decision had not yet been made about who Seth would hire to represent him at trial. However, it also seem very clear that Seth had talked to Barth and his office - Barth already had information from Seth about the case, and Barth knew that Seth might retain him. That creates an attorney client relationship between Seth and Barth, even if Seth never speaks to him again. It triggers certain legal and ethical duties Barth owes to Seth- confidentiality, not speaking to other parties or potential parties who are not represented by counsel, not to accept employment that is directly adverse to Seth if it relates to matters that Barth discussed with Seth.

But the big thing is - Barth did not deal fairly with Kat, and IMO he took advantage of the fact that she had no lawyer to advise, in confidence, that her that her legal may be adverse to Seths and that she should not talk to Barth or make disclosures that could be used to incriminate her. It was Barths duty to refuse to talk to her about the murder and her involvement without first having her consult with her own counsel.

OH MY GOD

I just listened to Kats lawyer read the 6-page letter from Seth while he was in jail encouraging ther to commit suicide if he gets convicted, including two sexually graphic and perverse rituals Kat must perform within days before killing herself.

He instructs her to engage in graphic, lurid sexual encounter wherein Kat essentially rapes her little brother. He labels this ritual: Lesser Ritual - Ben. Ben is her little brother.

The second ritual Seth commands is for Kat to completely humiliate and degrade herself by allowing 10 strangers to perform every variety of sexual act on her repeatedly until they have completely used her up.

The final ritual is to kill herself.

I have seen a lot of really evil criminals go through trials, but I have NEVER been this angry and this disgusted at a criminal defendant. Not even Jodi Arias could provoke this kind of anger.

Yeah, there is no way he can take the stand. And theres also no way that Kat was the manipulator and dominant force in this relationship

I was under the impression that Kat's most recent story, to the GJ and here in this case was that she was the innocent, scared submissive, so embarrassed by her own nudity and that she put the bags over Lizzi's head after she felt for a pulse and found none. She admitted that she felt Lizzi was dead. She admits to being the one who dumps the body, but why? She described a scene where she was doing the heavy lifting because SM was too tired, couldn't do it. I didn't find her testimony to be believable on this last accounting of events of that night.

I don't think she could admit to killing Lizzi and get off on the murder. JMHO

She admitted that she helped strangle Lizzie and put bags over her head. IMO she was not trying to make herself look good or innocent.

I haven't listened to all the trial but I did listen to Kat describe how she was told to hold the rope and she held it loosely, she believed Lizzi was dead when she put the bag on her head though she didn't say it out loud and she was the submissive doing these things because that is what Seth wanted. She continuously said that over and over again.
