He's describing suffocation... which he describes as smothering... it isn't as visible... but when asked by Atty Barth if someone appearing to have a reddish face might have been smothered, he says this... Dr. Kanfer: "if there’s a lack of oxygen because of smothering, the heart doesn’t pump as it should and you can have a backup of blood, most noticeable in the face and the neck." This, as Atty Barth argues that Lizzi Marriott was suffocated by Kat McDonough, and not strangled by the defendant.

Question for minor: But DOES.IT.MATTER? I thought that if someone died in a felony situation, but didn't do the actual killing, that they too could be charged/convicted even if *that person* didn't *pull the trigger* so to say. I've seen all over the place, so I'm confused.

Also minor, if you are still here, I asked a question previously and will ask again as didn't see answer. They keep referring to grand jury testimony. I ALWAYS thought (erroneously?) that GJ testimony was ALWAYS confidential. Can you explain Minor? TIA!

Uh oh, expert doesn't know about State stipulations. oh boy...

Sounds weird. I thought in all hypothermia deaths the victim is in a fetal position, trying to stay warm. This doesn't sound right.

Oh, I don't think in all. I thought in some hypothermia cases victims start to get disoriented and wander around, then start to actually have the sensation that they are getting warm.

Probably not - only if its an expert who is going to testify

Whoa, are you saying this person is NOT an expert, but kinda misleading to the jury that it was and the jury doesn't know this fact? And the laws for the difference on the two.

Hmmmm, strategy strategy - would be interesting if msm picked up on this little jewel.

Overcharging the tax payers? bad expert witness.

OMG, Barth! Mocked about his "google presentation". No, he is not thin-skinned at all... :)

I never heard of that so what happens in those cases? Do they disrobe?

Is Barth stumbling with his words? He sounds very confused? imo

I feel like I dropped in soap opera land... 'the young, the old, the infirm oh and the bad'

State time tomorrow morning is 10:00am est. I should have added 'and the late' to that soap saga.

  • #633
So far I am not impressed with the defense case. imo

  • #634
Barth is looking worried

I think Barth has read this thread. I mean, he wasn't "mocked" in open court about the google search/presentation. The NH ME was incredulous, but not mocking. We, on the other hand, were quite mocking.

From what we know, these 2 witnesses were going to be Barth's strongest, hate to tell him big fail

Because it's ridiculous, really.
