The State objected to the defense just now turning this over to the State, at this late date so to speak. The defense throws up motions to dismiss in every trial I have followed and I didn't see the State upset with the lateness of the material being supplied to it.

True, the motion to dismiss is generally in response to something that happened in court at that time, hard to plan for. In this case, it seems to be that Barth wished he hadn't put one of his office staff on as a witness. That was a first!

Rmember when HLN had their news reporter called as a witness in the Jodi Arias trial? That was so ridiculous, and of course she wore the shortest skirt she could find.

But don't they usually go on to say..." and the white shirt with the strip-ped tie!" They can stop at the vest, no one else would wear that! :floorlaugh:

Remember earlier when the Prosecution asked for a mistrial? I am wondering if a mistrial is something that would benefit the state and how?

Can you recall why? I know it had to do with Barth's opening statement but I don't remember what Barth said that caused the state to want a mistrial.
