He says he was aware that Seth and Kat were into domination sex... that Seth tied her up on a number of occasions, and he says there was a significant amount of rope in the apartment, and remembers at least once seeing it tied to the frame of their futon/bed.

Imo, Barth was trying to indicate that KM was the leader on looking for more girls for SM, that she was more in charge than she admits. jmo and all that jazz.

Even if is WAS true, doesn't relieve from the charge. It wasn't done at gun point. Just like we see in many cases, someone didn't pull the trigger on a murder, but the persons with them are still charged and convicted with the same charge as the shooter.

To me this brings up a topic of current interest as far as internet gaming and demonstrates how two individuals can play these role play games and have very different results in the real world. SM demonstrates some type of mental illness, personality disorder. This guy (except for being in apartment while KM and SM had sex) seems grounded in reality
So this could shed some light on the topic that these video games can be the cause of criminal behavior. At least in this case I don't think the video games caused the criminal behavior.
