I see that @Laughing has provided info on what KM had to gain by keeping Harmony in their household. IIRC, KM continued to fraudulently claim social welfare benefits for Harmony even after Harmony was gone.

In their order denying the motion, Judge Amy Messer cited commonality in the dockets: “The defendant is the common perpetrator and Harmony is the common victim” and Kayla is a “central witness in both cases.” Among other factors, the judge also cited “significant duplication” of witnesses, testimony and evidence.

In a separate order, the judge addressed Adam’s request to prevent prosecutors from showing some key pieces of evidence to the jury. Previously, his attorneys asked that an encounter Adam had with police on Dec. 31, 2021, before his arrest, be excluded from evidence. They also asked the judge to prevent the prosecution from introducing evidence that he purchased lime, a metal-cutting blade and a grinder from Home Depot.

The judge ruled the police encounter will not be excluded, but did limit the prosecution on their intent to introduce evidence of Adam’s “demeanor.” The ruling also limits some of the evidence surrounding Adam’s weapons convictions and other incidents of alleged abuse against Kayla and Harmony. The judge denied Adam’s request to prevent evidence of the Home Depot purchases.

The judge ruled that the jury can see a video from a September 2021 encounter between Adam Montgomery and police in which officers questioned him about Harmony's whereabouts. But jurors won't be allowed to hear the audio of the questions put to him because of his right to remain silent.

The court also said prosecutors can only introduce evidence relating to alleged domestic violence against Adam Montgomery's wife, Kayla Montgomery, from between December 2019 and January 2022. Nothing involving incidents prior to that range can be admitted.

Prosecutors can also only discuss alleged neglect and abuse toward Harmony in that time frame.

Evidence of drug use can also be introduced. Prosecutors had argued that drug use can lead to paranoia, and it would answer a lot of questions, including why the family became homeless. Prosecutors also believe drug use is directly connected to the circumstances around Harmony's death.

Recently, a judge ruled that the jury will get to see his conversations with police where he refuses to help them find Harmony, and denied a defense request to keep out evidence related to the purchase of lime at Home Depot.

Montgomery is currently serving a decades-long prison sentence in a weapons theft case. At sentencing, he denied killing Harmony.

A judge heard final motions Friday before Adam Montgomery goes on trial next week on charges that he killed his 5-year-old daughter, Harmony.

Jury selection is scheduled to begin Tuesday as prosecutors try to prove that Adam Montgomery killed his daughter in 2019. He is charged with second-degree murder, second-degree assault, abuse of a corpse, falsifying evidence and witness tampering.

After they're seated, jurors will be bused to locations around Manchester that are connected to the investigation. Opening statements are expected to be delivered Wednesday.

Prosecutors likely tried to work out a plea agreement, said Keefe, the Nashua defense lawyer. He said with the conviction in the firearms case, the sentence offered likely would have been steep.

Montgomery “has nothing to lose” by going to trial, Keefe said.

Throughout the investigation, police have kept Harmony’s memory alive by including pictures of her on poster boards at most news conferences.

She would be 9 years old now.

The emotional aspects of the case will likely play in the prosecution’s favor, Keefe said.

“A jury is going to want to blame someone,” he said.

Jury selection is scheduled to begin at 8:30 a.m. on Tuesday. The trial is scheduled to continue daily when court is open through Feb. 29. The trial will be held in Courtroom 1 of Hillsborough County Superior Court Northern District in Manchester.

According to the murder affidavit, Kayla Montgomery told police that Harmony's final moments of life were agonizing, saying she moaned in pain until she died.

Kayla Montgomery told police that Harmony's face and head received blow after blow as Adam Montgomery reached back from the driver's seat, delivering violence as he drove.

December 2019: According to court records released in 2023, Kayla Montgomery, who was Harmony’s stepmother, told police that Adam killed Harmony on Dec. 7, 2019, while the family lived in their car.

Kayla said he was driving to a fast food restaurant when he turned around and repeatedly punched Harmony in the face and head because he was angry that she was having bathroom accidents in the car.

“I think I really hurt her this time. I think I did something,” he said, according to Kayla Montgomery.

Jury selection could take the next day or two. The court is planning for opening statements to proceed on Wednesday.

In Superior Court in Manchester, NH for jury selection in #AdamMontgomery murder trial. He is charged w/murder of his daughter, #HarmonyMontgomery. She has never been found.

Montgomery, 34, has pleaded not guilty to killing his daughter Harmony Montgomery, who was reported missing in November 2021, nearly two years after police believe she was killed. Her body has not been found.

June 2014: Harmony is born while her father, Adam, is in prison, according to WMUR-TV. Custody is granted to Crystal Sorey, Harmony’s sole caretaker.

This is one of the worst cases of child abuse I've ever read here. What a monster.

Hopefully Kayla will testify to everything, and he will be locked away.

Another case, where DCFS was notified of abuse, prior to a child's death. I would think that a report made on a child living with a bio father who had been in prison, and a step mother, any report of abuse would have been throughly investigated. Great, a caseworker checked on her...that person should be fired.


The rest of the story is even more gruesome. Kept the dead body of a child? Carting her around?! In a freezer at work, in a ceiling at their shelter? Until the bag was "leaking"?

Gross. And weird. So, I am thinking, fastest jury conclusion since Alex Murdaugh trial. I don't know why this guy didn't take a plea?! Well, he isn’t going anywhere.

Jury selection continues tomorrow. The defendant requested leg shackles instead of a brace due to discomfort and the judge obliged. This dude is so gross, what about Harmony's discomfort after he repeatedly punched her in the head?
