Local and state law enforcement confirmed a 72-year-old resident of a mobile home park in town was a homicide victim who died from a single gunshot wound. Sally A. Miller, 72, was found by Goffstown police officers Friday afternoon after they arrived at 66 Rachel Circle to perform a welfare check. An autopsy done Saturday confirmed the cause of death.

State prosecutors did not give an address for the homicide scene, but there was crime scene tape, and investigators were seen going in and out of the Rachel Circle home. The Goffstown online property database also designated Miller as the homeowner at that address in the park, which is reserved for those who are 55 years or older.

"Investigators have charged the daughter of a 72-year-old Goffstown woman found dead last week with second-degree murder.

Deputy Attorney General Jane E. Young, New Hampshire State Police Col. Christopher J. Wagner, and Goffstown Police Chief Robert Browne issued a statement Sunday night saying Jennifer Clow, 49, was arrested in connection with the death of her mother, Sally A. Miller.

On Sunday, officials said Clow was arrested in Naples, Fla., on a fugitive from justice charge based on an arrest warrant issued on Saturday charging Clow with alternative counts of knowing and reckless second-degree murder. Clow is being held in Florida awaiting arraignment on Monday. Authorities plan to seek her extradition to New Hampshire to face the second-degree murder charges."

Different states have different classifications for the type of murder. For New Hampshire:
"TITLE LXII CRIMINAL CODE

CHAPTER 630 HOMICIDE

Section 630:1-b
630:1-b Second Degree Murder. –
I. A person is guilty of murder in the second degree if:
(a) He knowingly causes the death of another; or
(b) He causes such death recklessly under circumstances manifesting an extreme indifference to the value of human life. Such recklessness and indifference are presumed if the actor causes the death by the use of a deadly weapon in the commission of, or in an attempt to commit, or in immediate flight after committing or attempting to commit any class A felony.
II. Murder in the second degree shall be punishable by imprisonment for life or for such term as the court may order."

Section 630:1-b Second Degree Murder.

So it seems the knowingly and recklessly come from the statute. And since Sally was shot with a gun that would meet this definition of a deadly weapon.

Jennifer Clow, 49, reserved the right to ask for an evidence-related hearing in the future, where her release could be a topic, said homicide prosecutor Jeffery Strelzin, an associate New Hampshire attorney general. Strelzin spoke in the lobby of the Hillsborough County Superior Court, where Clow would have appeared had she wanted to see a judge.

At present, Clow faces alternative murder charges. One that she knowingly murdered Miller, the other that she recklessly did so, Strelzin said. He said an investigation is ongoing and that he will eventually take the case to a grand jury."
