Setback for alleged drunk driver charged in NHL star, brother's deaths

The alleged drunk driver accused of killing NHL star Johnny Gaudreau and his younger brother Matthew with his car has lost a major court battle in his ongoing trial in New Jersey.

The court threw out the request to not use Higgins statements at the scene, due to not having his rights read to him at the time..

"However, Judge Michael Silvanio ruled police weren’t obligated to read Higgins his rights at the scene as they were quickly trying to gather facts in the immediate aftermath of the crash along a country road in southern New Jersey.".

At this point, Higgins should just man up, and take a plea.
