The court threw out the request to not use Higgins statements at the scene, due to not having his rights read to him at the time..

"However, Judge Michael Silvanio ruled police weren’t obligated to read Higgins his rights at the scene as they were quickly trying to gather facts in the immediate aftermath of the crash along a country road in southern New Jersey.".

At this point, Higgins should just man up, and take a plea.

The family of Johnny Gaudreau flew from South Jersey to Milan Italy to support the US Olympic hockey team. The US men’s team has the jersey of South Jersey’s Johnny Gaudreau in their locker room to honor him and remember him as they go for the gold.

Higgins defense team went to appellate court, to try to get everything Higgins said at the scene taken out of the court record, as he had not been read his Miranda rights at the time police showed up at the scene of the wreckage.

Of course! The police had not put him under arrest, they were just asking him what happened. The fact that Higgins incriminated himself, is hardly the fault of the officers on the scene.

There is no point to the ongoing drama here. Higgins was drunk, mad, and passed a slow vehicle on the wrong side and killed the Gaudreau brothers. Take a plea or go to trial, LWOP. There is nothing else to see here.
