Trying to decide if the jurors will be allowed to take notes during the Trial.

I get the feeling that Jury selection is going to take some time because they have more than 25 voir dire questions to get through, some in groups, some individually-- the parties argued about this.

According to the Judge, the trial is expected to last right up until Thanksgiving or November 26, 2025!

Jury selection was set to begin Monday in the highly anticipated murder trial. But after the New Jersey Supreme Court agreed to hear an appeal of whether some evidence in the case can be excluded, Superior Court Judge Marc C. Lemieux delayed the trial until Jan. 5.

Meanwhile, Caneiro's defense team maintained that the defendant must be released on Sept. 14 under New Jersey bail reform, which sets a limit on how long the accused can remain in custody before trial.

Lemieux, Monmouth County’s assignment judge, set a hearing for Sept. 12 on whether Caneiro should be freed. At issue is whether the Supreme Court's decision to hear the matter stops the clock for the time limit set by bail reform.

At 3:30 p.m. Thursday, the state's highest court granted the Monmouth County Prosecutor's Office the leave to appeal Lemieux's ruling on the exclusion of evidence, Lemieux said.

Authorities allege Paul Caneiro, 58, walked up to the security surveillance system in the garage of his Ocean Township home and shut it off at 1:29 a.m. on Nov. 20, 2018, to mask his departure to drive to Colts Neck and murder his brother and his family under cover of darkness.

In his ruling, Lemieux said even though Caneiro later gave police written permission to examine the contents of the security system, that did not negate the unconstitutional seizure of the equipment without a warrant.

Caneiro has been charged with 16 crimes, including arson and four counts of murder.

So heartbreaking!! She didn't mention her Dad or include any pics with him so I wonder if she believes he is guilty. Such an impossible situation for the whole family. I can't believe it's 7 years later and still no trial.

7/7/25 Update: Assistant Prosecutor Nicole Wallace recited those allegations [due to financial desperation & fear of his brother discovering his misappropriation of funds; Prosecutors allege Paul Caneiro was stealing from his brother's trust fund & using the money for personal expenses, including an extramarital affair. Keith Caneiro's final phone calls to Paul, demanding explanations for the missing money, are believed to be the catalyst for the murders] at a hearing July 7 in an effort to convince a judge to allow a jury to hear evidence at Paul Caneiro's upcoming trial of what the state asserts was his financial motive to commit the murders. During the hearing, prosecutors played video from Keith Caneiro's home-security system, which contained audio of the final three calls he made to Paul on Nov 19, 2018. The security system only recorded Keith's side of the two-way conversations. At trial, Wallace said she plans to call as a witness a woman the defendant was having an affair with. The woman is expected to testify about the money Paul Caneiro was spending on her during their relationship, Wallace said. Monika Mastellone, Caneiro's attorney, argued the affair was irrelevant to the murders & the jury shouldn't hear about it. But Superior Court Judge Marc C. Lemieux, who presided over the hearing, said prosecutors are offering the affair to show the defendant was "trying to have a certain lifestyle with this woman" that could be jeopardized by his loss of income. Lemieux, however, ruled that prosecutors can present some evidence found on the defendant's Apple iPhone & Apple watch, both which also contained communications between Caneiro & his dead brother, Keith. Lemieux limited evidence from Paul Caneiro's phone to information generated between Nov. 19 & Nov. 20, 2018. That includes data likely indicating the defendant's whereabouts when his brother, sister-in-law, niece & nephew were murdered & the time frame leading up to murders. Lemieux has yet to rule on other defense motions in the case seeking to bar the state's arson * ballistics experts from testifying at trial & to suppress evidence of a financial motive for the murders.
7/24/25 Update: Written ruling by Monmouth County Judge Marc Lemieux rejected Caneiro's bid to bar the state's arson expert from testifying at his upcoming trial in the murders of four family members, clearing the way for prosecutors to put forth their timeline for the series of crimes the defendant is accused of. Attorneys for Caneiro asked Superior Court Judge Marc C. Lemieux to bar Detective Joseph Cordoma from testifying at Caneiro's upcoming trial, questioning not only the detective's qualifications, but also the methodology he used in reaching his expert opinion in the case. However, Lemieux, Monmouth County's assignment judge, cited Cordoma's training & the more than 100 fire investigations he has conducted during his 24-year career in law enforcement in ruling that the Monmouth County Prosecutor's Office detective is qualified to testify as an arson expert. Trial set to begin with jury selection on 9/8/25.

COLTS NECK, NJ — A Monmouth County man will remain behind bars for at least four more months after a judge ruled against releasing him before trial on Friday on charges accusing him of killing his brother and the brother's family in 2018.

According to a report from the Asbury Park Press, Caneiro's attorney, Monika Mastellone, argued for Caneiro's release by arguing that a time limit to keep Caneiro in jail without bail under the state’s bail reform law was set to expire on Sept. 14.

In the Criminal Justice Reform Act of 2017, it’s stated that a defendant must go to trial within 180 days of an indictment or be released from jail, the report said, though under some circumstances, that period can extend to 200 days.

During Friday’s hearing, the report said Christopher Decker, deputy first assistant Monmouth County prosecutor, argued that the 200-day period can be extended further when the court can’t proceed to trial.

In his written ruling, the report said Lemieux agreed with Decker and ruled that the prosecutor’s appeal was “a valid exercise and preservation of appellate rights on suppression ruling, not a concession of unreadiness.”

Caneiro's wife and two adult daughters sat in the front row of the courtroom for the hearing, the first time they have been spotted at proceedings in the case. They left the courtroom without speaking to the press.

At this point, the trial has already been delayed well beyond 200 days due to the closure of the state court system and resulting backlogs stemming from the COVID 19 pandemic in 2020. In addition, various motions filed by Caneiro's defense attorneys and subsequent pretrial hearings pushed back the trial date even further, although delays resulting from the defense motions don't count toward the time limit prosecutors have to bring the case to trial.

I went back and only saw this, "Lemieux issued a written decision about 5:30 p.m. ordering that Caneiro remain in jail pending trial, which is scheduled for Jan. 5."

I will check the Monmouth County Courthouse website and see if I can find some info
