yes.... and that is why i'm surprised they gave morphine w/o any examination. hell--- i could barely get hydrocodone prescribed at 9 a.m. on a saturday, when i'm at "urgent care"- and head is swollen grotesquely from abscessed upper tooth.
Yeah, I don't understand that at all. Sure, Alexee might have wanted painkillers, but if you refuse an examination, you don't get them. All they needed was a stethoscope, and they'd have heard the baby's heartbeat. Around here, they don't issue those painkillers without a lot of investigation, because of addicts going to ER and wanting them for specious reasons. And, in Alexee's case, they knew incontrovertibly she was pregnant, even though she said she had no sex.

This ME says it's unknown what the "drugs" were from published info. This means we might be swatting around a rumor if we're discussing morphine or hydrocodone?

By "drugs", Alexee's attorney might even have been referring to a saline drip? It's not a drug, but the attorney might be deliberately conflating?
 
AT attorney interview, 06/29/23

The attorney is saying the hospital knew Alexee was pregnant, but hadn't told her before she went to the bathroom. He said they were waiting on the blood test.

IIRC, they had the urine test already. Those are so straightforward, you can do those in a home pregnancy test. The blood test is for "how far along"?

IMO Alexee is going to keep insisting she didn't know she was pregnant, even though she'd been told.... BUT the only witnesses will be medical personnel, and they'll be quite clear they discussed it with her.

Did she and her family properly bury her baby boy? It is so powerful to see her tiny baby has an attorney representing him. Alex Ray Fierro is represented in the wrongful death caused him by his own mother. Will she ever realize the gravity of what's been done here?

I watched the appalling footage of her with her mother at the hospital on Law and Crime. They showed her wearing a cheerleader outfit that was bursting at the seams. Her mother wore blinders for self-preservation. The footage of the arrest is messy and shows an uncooperative parent. More than anything, neither mother nor daughter became sympathetic characters. The jury is likely to feel the same way when they view it.

I see the baby's name here, as well as the boyfriend's and AT. Are they all suing ... the hospital?

The filing of wrongful death claims is time-sensitive and dependent on the state statute-- typically 2 years from the date of death.

The biological parents were named as "interested persons" by the petitioner. Is the petitioner here a friend of the family(s) or why the interest in this death?

“Interested person” means any person who may reasonably be expected to be affected by the outcome of the particular proceeding involved. Here, this would also be a beneficiary.

During the police interview with the House Supervisor (Marina), I also recall that when questioned by the Supervisor, AT did not want to name a father on the birth or death certificate.

Sure sounds like a cash grab to me and guess we'll have to wait until the court appoints a personal representative for the estate of the deceased baby boy to learn more details. JMO
 
The petitioner is listed as Arthur Bustos. There is an attorney by that name in the area that has handled wrongful death cases, but other than that, I've got nothing.
Same for the other attorney listed, Damon C. Richards. Medical malpractice and wrongful death are some of his practice areas.

Morphine and phentarmine in system. It is believed the hospital gave Alexee the morphine, despite her pregnancy. But the phentarmine? It's a weight-loss drug, an amphetamine.

The nurse mentioned Alexee told her she stopped taking birth control pills and started taking diet pills (presumably the phentarmine). Ergo she knew she was pregnant, since she didn't need birth control pills any more.

I'll bet Alexee was taking the phentarmine not just for diet, but also so she could induce a miscarriage.

At any rate, LE will have this all on her electronic trail. What she Googled and why. I hope they confiscated her technology ASAP, but I have a feeling they dawdled and dawdled and dawdled....

IMO, the morphine was a therapeutic level whereas we don't know how long she'd been taking phentermine which has it's own warnings for an adult -- let alone an unborn child!


Do not use phentermine if you are pregnant or breast-feeding a baby. You should not use phentermine if you have glaucoma, overactive thyroid, severe heart problems, uncontrolled high blood pressure, advanced coronary artery disease, extreme agitation, or a history of drug abuse.


This dangerous diet pill was yanked from the market by the FDA in 1997 because of its association with serious cardiovascular problems. Phentermine was the “Phen” in Fen-Phen. Along with fenfluramine (“Fen”), the duo of ingredients was linked to heart and pulmonary emergencies, many of which resulted in death. In 2012, the Food and Drug Administration approved the sale of phentermine while other countries continued to ban the diet pill.
 
I still find it hard to believe the hospital gave Alexee a shot of morphine just like that, without any diagnosis, without having the result tests... As far as I know the hospitals do not give the opiates left and right like candy, more like the ooposite. We know though that Alexee was in pain for a couple of days before she went to the hospital. Did she have access to opiate painkillers anywhere at home?
