A monthlong search for a missing 11-month-old Ten Sleep boy ended in tragedy Tuesday in New Mexico when the infant’s non-custodial mother allegedly shot and killed him as authorities attempted to negotiate a handoff.

Madeline Daly, 35, is being held at the Grant County Detention Center in Silver City, New Mexico, on a charge of first-degree murder, according to Grant County Sheriff Raul Villanueva.

Madeline Daly, 35, had taken off with her 10-month-old son after a judge awarded custody to the child's father. The whereabouts of the Wyoming woman and her son, Basil Emeric Daly, were not known for over a month, until information surfaced that the mother and son were in the area of Mimbres, New Mexico.

It’s believed that Basil Daly's mother and noncustodial parent, Madeline Daly, has taken him and refuses to return the baby in defiance of court orders, said Washakie County Sheriff Austin Brookwell.

Basil’s father, Jake Stoner, who lives in Kilgore, Nebraska, roughly 500 miles from where Daly was last seen, said it’s been an ordeal since he learned that his son was missing.

“It’s just very worrisome and heart-wrenching to know that you don’t know if he’s safe, or even have a vague idea of where he’s at,” Stoner told Cowboy State Daily.

The couple, who were never married, have been embroiled in ongoing custody battles in recent months with Stoner attempting to force Daly to comply with his legal visitation rights with his son, according to Stoner’s lawyer, Christopher King.

Prior to her leaving town, the pair were supposed to meet for a court hearing on Oct. 21, but when Daly failed to show, Washakie County District Judge Bobbi Overfield granted Stoner temporary emergency custody.

It sounds like MD was determined to be a single parent to baby Basil from the get-go. She wanted to be independent and fully in control with no concessions to Basil’s father, even to the point of shooting and killing her own baby.

I wonder what the custody order was (before the emergency order that issued when MD failed to appear for a scheduled hearing). The parents lived about 500 miles apart…maybe it was a week on/week off type of schedule? That can be hard on everyone, including the child. I’d be very interested in seeing that original custody order, but there is no free online search in Wyoming that I can find. The clerk of courts has a fee for requests.

MD is not yet listed for arraignment. I suppose the delay is due to the holiday.

How on earth did this woman get visitation rights after being in an earlier standoff with LE?

I actually paid $15 to obtain those records from Nebraska. I was able to print them out but could not save them, so I cannot post them here, unfortunately. I will just say that the incident happened over a decade ago, and the final charges are inconsistent with what was reported in the article you reference. I suspect the truth lies somewhere in the middle, moo.

“A woman wanted for kidnapping her 11-month-old son reportedly told authorities she doesn’t know why she shot and killed the boy, but that in her mind, she couldn’t let her ex or his family have him.

“Even if the rest of life is worthless she would do it again just so to make sure that the (family) didn’t touch him,” Detective Lt. Jason Jordan of the Grant County Sheriff’s Office in New Mexico wrote in an affidavit of probable cause filed in the case and made available Friday.”

She does have this charge which she had a hearig on 12/24/25. No update on the murder charge, but NM is slow in updating their court site.

Case info: Basil Daly had been reported missing on Nov. 19 by his biological father, Jake Stoner, of Kilgore, Nebraska. He notified authorities after Daly, who had fled to an RV park in Ten Sleep, had left following a missed custody hearing in Washakie County after he had been granted emergency temporary custody. Stoner’s attorney, Christopher King, told Cowboy State Daily on Wednesday that Stoner is understandably devastated at the outcome & is on his way to New Mexico. He earlier said that he had wanted to be a father his entire life and was enjoying getting to know his son. Daly had eluded authorities for more than a month after leaving the Worland area where she was last seen, despite a nationwide Be On the Lookout (BOLO) & a felony warrant for her arrest. In a fiery opening, Mark Abramson with the Grant County District Attorney’s Office argued that given the “outrageous circumstances” of Daly’s actions, that there was no way she should be released.

“A mother absconded with her child from Wyoming, traveled around — we're not sure where — but ended up here being confronted by law enforcement and chose to murder her child, her own child, with a 9 mm gun to the face,” Abramson said.

“We are concerned that not only is the case strong, but the likelihood that this defendant would abscond again and would find herself outside of the jurisdiction of Grant County or New Mexico is just too great,” he added.

Abramson also argued that the crime Daly’s charged with is “as personal as you can get.”


Bail denied.
