No new evidence but something came up during Mr. McCann's testimony. About the Glock not being in the house as McKay brought up during cross of McCann. Shocking to Serna that it was brought up. Regarding the Glock being there and the basis of the civil suit brought by Tera's parents. Serna has re-supoened Samantha Wheeler because she knows that LC left the gun in the house for Tera for self protection. The state keeps coming up with these theories -- it's hard for us to keep up with it all--quote by Serna. Ha ha. It's been a given fact that the gun was there. It's done all the time, to recall a witness, and the prosecution has never objected before in Serna's 36 years. Referenced Zimmerman's case.
McKay is saying this isn't new--asked McCann and PTI--about the gun being present. McKay is saying it's not a hearsay statement--Both Wheeles said in initial interview with Jones say LC has several different guns, mention by name, in top drawer. Top drawer? SW--in top drawer, yes. "Have you ever gone to shoot a gun?"--No, Levi has never taken me. Never mentioned Glock by name, according to defense, in TOP DRAWER, not armoire....basis for this. So they don't know for sure if it was the Glock.
Serna is talking about hearsay between SW and Tera, just wants to ask SW if she knew where the gun was in the house. Serna is whining about heresay statements that he has approached the judge with previously that were admitted....brought up 'worthless piece of skin' again. Judge let in hearsay statements that hurt LC and therefore judge should let in statements by SM about gun being left in house.

Fundamental unfairness....serna is still whining. 10 or 12 hearsay statements that the state has slipped in that were allowed. Piece of skin mentioned yet again.
Judge allows SW to testify again. McKay--doesn't know which gun it was, stored in top drawer not armoire, and LC never taking her to shoot.
Serna--mentions same thing that McKay did and says it's fair game.
Judge rules against State, I can't hear him....but McKay jumped up with objection to what judge said. McKay--leaves false impression with jury.
Serna thanks judge so apparently he won. Of course, he always does.

When they retire, why don't they just quit working and find a hobby? That is what my DH did, and he is loving retirement.
