Here we go again-On the 18th the judge will rule on the following motions (layman's terms):
- Will the plea deal stand in that WW can only be sentenced up to 2.5 years max because that was his time left to serve?
- Does the law that would apply to the plea deal cover the probation violation? If not then the judge can consider aggravating factors (ie the callousness of Tawni being left on the side of the road, the possibility that he in fact knew her name, the possibility that she was kidnapped for the purposes of prostitution) and sentence him to the max of 3.75 years.
- Will WW have to face a restitution hearing; this is almost unique to AZ in that criminals are required to pay families compensation for the loss of the person or property. WW is on the hook for a quarter of a million dollars-the defense is arguing that the plea deal waived restitution. Long story short, restitution CANNOT be waived, even by the victim themselves so the restitution hearing will likely go forward on 11/30.
- The letters-whose get to stay and whose are struck? Family members letters will likely stay...friends and WSers are the letters at issue.
