IDK if they had time to go inside and call 911 before EN shot at them again. Based on the info in the court doc, it appears that EN rolled up as they were exiting their vehicle.
It would be enlightening to know what the CA statutes are regarding self defense.
I think if the DA suspects that BM acted criminally and if there is evidence to support that suspicion, he may charge him accordingly.
Hypothetically speaking, if I was shot at by someone in a car, and then returned home and saw that same car approach my house (on a dead-end street) minutes later, I'd have no reason to believe that person had anything but ill intent toward me. I'd have every reason to believe that person was following me to kill me or my loved one(s). If I was armed, I'd do whatever I felt was necessary to protect myself and my loved one(s) and I'd let the police sort out whether or not I was defending myself.
If I had time to get into the house to call 911, I'd do that. If my assailant pulled up before I could get into the house, I may shoot at the person who had only minutes before shot at me, if I believed my life or my loved one's life was in imminent danger & I believed it was necessary to protect myself or my loved one.
As it is, the only info we have is that EN shot first - at both locations.
