Extent of injuries revealed for man whose wife, daughter were slain

There were times when Gaudia Martinez-Seal was unsure if her brother would pull through.

Arturo Martinez, 39, survived a brutal random attack last month at his central valley home, but his wife and daughter did not.

He suffered repeated blows to his head with a claw hammer in the April 15 assault, resulting in at least 17 fractures to his skull. He had more than three dozen staples inserted in his head, Martinez-Seal said.

Las Vegas police couldn't speak to him during their initial investigation because his condition was so dire.

I'm glad they are going for the death penalty against the man they believe committed these horrible crimes.
 
Bryan Clay pleads not guilty in bloody Las Vegas slayings

A 22-year-old man accused of sexually assaulting and killing a Las Vegas mother and daughter and nearly killing their husband and father with a hammer has pleaded not guilty.

Bryan Devonte Clay Jr. appeared in court Wednesday morning to enter the plea on 10 felony charges, including murder, attempted murder, sexual assault, kidnapping, robbery and burglary.

Man hurt in family home attack forgives assailant

Forgiveness is the message from a Las Vegas boxing coach who was nearly bludgeoned to death in a hammer attack that left his wife and their daughter dead at their home.

In words slowed by brain injury and his own emotion, Arturo Martinez on Thursday called forgiveness 1 of God's commandments.

But he says the man who attacked his family also must face justice.

Opening statements begin in trial for man accused in brutal 2012 murders of woman, child

Bryan Clay, 27, faces the death penalty for the April 15, 2012, rape and killings of Yadira Martinez and her 10-year-old daughter, Karla. Arturo Martinez, Yadira’s husband and Karla’s father, was savagely beaten in the head with a hammer.

“He was so damaged by this that he was literally non-verbal and in the hospital for weeks,” said prosecutor Pam Weckerly.

Prosecutors say within days of the murders, Clay's DNA was matched to the crime scene and to a sexual assault of another woman the same night, in the same neighborhood.

Prosecutors said they found Clay's DNA and fingerprints at the crime scene. The defense argued that the findings were inconclusive and biased. They said now it's time for the public to hear the other side of the story. Sgro called it a story of suspicious neighbors and shoddy police work.

"We actually have analysts in this case that have made mistakes and gone to their supervisors and said I was stressed out. I was under a lot of pressure. I have a huge backlog and I need to get it done," Sgro said. "I'm going to ask every scientist when they hit the stand, 'What conversations did you have with the state after my opening statement? And what modifications have you made to your testimony?' Because now they know what we're going to hit the analysts with."

Sgro also argued that officers failed to adequately look into the Martinez family's neighbors. He said the night of the attack, father Arturo Martinez got into an argument with the neighbors over a parking dispute that had been going on for years.

Las Vegas Metropolitan Crime Scene Analyst Noreen Charlton testified for hours, walking the jury through hundreds of horrible photos she took more than five years ago. Most of them were much too graphic to be published.

His wife lay motionless in a doorway. At first, he didn’t know whether he was dreaming. Then he stepped closer.

“I knew she was dead,” he told jurors on Thursday.

As Arturo Martinez stumbled through the home, he did not know he was injured until he realized he could not verbalize words to his older son. He hugged the boy and tried to shield him from the horror in their home.

The capital murder trial against Bryan Clay was centered around a 9-1-1 call on Tuesday. However, there wasn't any testimony about the killings.

Clay is also on trial for sexually assaulting another woman. Prosecutors played about 10 minutes of the 9-1-1- call the sexual assault victim made as she was being followed.

The defense didn't ask about the 911 calls but instead, focused most of their questioning on the police work and the credibility of the victim. The victim told investigators her attacker stole her cell phone, but she wasn't honest about everything.

Cristopher Martinez awoke that morning in April 2012 to discover his younger brother had a bloody nose. He went to grab a tissue, opening his bedroom door.

“I just see a puddle of blood,” Cristopher, now 15, told jurors Thursday, stopping to wipe tears from his face as he recalled the April 15 morning that he turned into the hallway and saw his mom on the floor. His dad stood over her, visibly bleeding on his head and unable to speak. His sister was also dead.

In the weeks since the trial started, prosecutors have argued that Clay broke into the family home on Robin Street in the early morning hours and used a claw hammer to attack the two, along with Arturo Martinez, while the boys slept through the nightmare.

Clay, now 27, was arrested within 10 days, after detectives tracked phone records linking him to a stolen phone following a sexual assault that occurred less than a mile from and within hours of the killings.

His attorneys, Tony Sgro and Chris Oram, have challenged the minimal fingerprints linked to Clay, the lack of bloody shoe prints, and whether the 50-year-old sexual assault victim picked the right photo out of a lineup.

After more than four weeks of testimony, the fate of Bryan Clay is in the hands of a jury. Clay faces the death penalty if he's found guilty of raping and killing a mother and her 10-year-old daughter in 2012.

After closing arguments Tuesday, jurors deliberated for about 3 hours before they were dismissed for the day.

During his closing argument, defense attorney Tony Sgro argued that there were many inconsistencies in the DNA and other evidence presented by prosecutors. Sgro questioned the way analysts handled and labeled DNA samples.

Sgro also questioned why investigators did not test a condom and bloody napkin found at a neighbor’s home. The neighbors had a known feud with the Martinez family, he said.

Arturo Martinez, whose wife and daughter were killed, was in court when the verdict was announced.

“I forgive him,” the man later said. “But I also want justice for Karla and Yadira.”

The trial’s penalty phase is scheduled to begin at noon on Wednesday.

But Bryan Clay, 27, wanted to say more than what was on the piece of paper.

“If it wasn’t for my attorneys and my daughter, I would be begging you all for death,” he said. “If my mom wasn’t sitting back there.”

“These actions have caused so much pain,” he said. “I don’t know how to explain my regret and my remorse in this situation. All I can do is express my love.”
