This is worded very strangely, IMO.

"Prosecutors said two teens had nonconsensual sex with the woman. They also say a third sex act occurred, but didn't specify who was allegedly responsible."

The teens said she was having sex with her dad when they first saw them. Pretty sure that's what's being referred to here.

Seems like the dna evidence from the rape kit would answer that question without a line up. Now if any were just watchers, that's low down, too.

The dna will identify some or maybe all those that had intercourse with her.

Without being able to identify the attackers in a line up how can she identify who hit her or who forced her to perform other types of sex acts?

Basically it will be a benefit to the defense. Personally I doubt if it will even go to trial.

Brooklyn District Attorney Ken Thompson said Wednesday the victim refused to cooperate, gave conflicting accounts, and was having sex with her biological father the night of the Jan. 7 alleged assault.

At about 9 p.m. on the night of the attack, the young woman said she was with her father at Osborne Park in the Brownsville section of Brooklyn when a group of five teens came up to them.

The father, who was the first to report the incident, told police one of the boys pulled out a gun and ordered him to leave. He did and that's when the suspected attackers took turns raping the 18-year-old, according to the victim.

The father went for help and when he came back with two uniformed officers, the culprits ran away, he said.

Officers found the young woman heavily intoxicated and later learned she'd been drinking in the park with her father, a police source told PIX11 News. She allegedly refused to get into an ambulance and bit an officer, the source said.

Along with recanting her story, the victim also refuses to cooperate with any prosecution against her father, who the DA said was engaging in sexual conduct with her.

Thompson added that there was a lack of reliable evidence, and that criminal charges simply cannot be sustained.

"It is my fervent hope that this young woman gets all the support that she needs going forward. My office, including our victim advocates who have been working with this young woman, stand ready to provide her with any assistance she may need," Thompson said.

No surprise. But did the boys have consensual sex with her? I thought they'd got their DNA but the victim apparently failed to pick them out of a line up. So were they there or not?

I'm annoyed. It's unfair these boys have been named if they're entirely innocent, their lives ahead of them but with google against them.

I'm angry. The boys names will forever be associated with this, and IMO, she has also affected other victims.

And the "father"...no words! He should, probably, be prosecuted for his lies alone!

Well, for one, she was intoxicated, was in the park with her father, when these males happened upon her. Could anyone have consensual sex with her in that condition? I don't feel one bit sorry for these males.

Well, if they teen boys WERE there, and if they DID have consensual relations with her -- public parks are not the area to engage in such behavior. And even if they are innocent of any gun threats or assault --but were out that night looking for trouble -- they'll now have a police record that will follow them ; and will be on the radar of law enforcement.

Still on the fence about their culpability.
Why did the young lady lie ? Was there a threat made with a gun, or not ?
Should the father be charged with false accusation --or whatever legal term that is ?

The young woman's father denied claims of incest made against him by two of the male teens.

'They're just trying to get out of the thing they did,' the unnamed father told the New York Post in January on his way to a deli to buy beer. 'I want them to rot in jail.'

If there was any dna from the now-dismissed teens-- wouldn't that be enough to charge them ?
So I'm wondering if there was no dna outside from her fathers'?
What a strange case.

I'm all for severe charges against anyone who assaults an innocent person-- but why did she drop charges ? Is it because there was no dna evidence of her being attacked at all ?

She refused to cooperate. It does not mean a rape or gang rape did not occur. If they thought she was lying or the video was false, they would charge her with perjury. A sad day all around because she is more destroyed than before.

She was drunk and unable to consent to sex with anyone including her sperm donor.

This clearly a young woman with a lot of issues. This situation is one more crappy thing that has happened to her.

They did find DNA on the woman from the two defendants. Obviously prosecutor didn't believe it was enough for the prosecution.
