The question I have is why did the father call the police?

From what I understand, the father and daughter were in the park drinking and having sex (ugh, can't even believe I'm typing that). The group of guys come along and also have sex with the girl. The father walks off and calls the police. From what the man at the deli said, the father didn't seem particularly urgent about making the call.

So, why was he calling the cops if the daughter was consenting? I don't get it.

Perhaps, he was afraid he would be found out. I can only speculate, but I doubt this girl was raring to have sex with he biological father and volunteered herself to those boys. I wonder if he offered her to them (I'm sorry that sounds so crass) and then got worried she would tell someone. He knew what he was doing could/would get him in trouble, and that she was not a willing participant in this. At the very least, he would get in trouble for incest. I'm sure he needed a story, so it didn't all come back on him.

Yuck yuck yuck. All of them need to be prosecuted, dad included. (But I understand that can't foce cooperation from the victim.) I would be shocked if she consented to any of it.

This poor girl. I cannot imagine how her life has been so far, that she would end up in Brooklyn park at night, having drunken sex with her estranged Father and two strangers. I really hope that this case has gotten her some attention and maybe some help from social services. :candle:

This young woman was in the park at night, by all accounts highly intoxicated. Then males she didn't know saw her and decided to have sex with her. It doesn't surprise me at all that he went and called the cops. Of course he got his own problems (to put it mildly).

You're right. I did jump to the conclusion it was consensual and that is probably an incorrect conclusion on my part.

Any which way I look at this, I don't understand how it happened or how/why the father casually (or so it seems) called the police.

Doesn't sound like that to me at all. Father engaged in his own conduct, and five males were engaged in their own conduct. From description of the story, father and daughter were having sexual contact in the park, when five males approached them and decided they wanted to have sex with the daughter. Father then left to look for police and eventually flagged down a police car. So the conduct was separate. And if the woman isn't cooperating they can no more prosecute the father than five males (which is what prosecutor is saying).

She is a legal adult and has refused to press charges, stating the sex was consensual. Nothing else can be done if the purported victim denies being victimized. And she is 18 years old.

The fact that her own father was one of her consensual "lovers" (puke) is so awful, but I suspected this from the first post. And apparently incest is not illegal for consenting adults. :(

Police said their investigation into the matter is “officially closed.”

Sick and disgusting to say the least.

Eta: wouldn't have LE arrested or charged him with incest (regardless of the victim objecting) if this were the case?

LE said she is no longer cooperating. Since they weren't there to witness the act, I don't see how they can charge him with no sworn accusation from her.

He is biologically related. That makes it incest. I already provided a link to the incest law: he doesn't have to be legally her father as long as he biologically her father and they (father and daughter) know it.

That was my question...why have they not charged him with incest? With or without her accusation. They admitted to having sex.

Their hands are tied, with her refusal to cooperate. Without her cooperation, there is essentially no victim for the court. Per what was linked above, LE is worried what it would do to her, even if they could prosecute.

I am not asking about the rape. I am saying if incest is a crime and he is her father and they admitted having sex....why was he not charged with incest? The state can file charges against him for the incest.

DA already said they wouldn't prosecute due to two reasons: woman isn't cooperating and they are concerned that prosecution of the father won't do her any good.

I am talking about the incest. She is refusing to cooperate in the incest investigation. Admitting to something happening, is not the same thing as a sworn statement. As linked in multiple articles above, LE can not bring incest charges without her cooperation. You can't go to court with no victim, or no proof of a victim. They still have the burden to prove two people were having sex. They have no official sworn statement, no victim cooperation. They can't go to court, based on them admitting something with no corroboration. That will not be considered evidence. They have no actual proof of the statement and no victim willing to corroborate the statement. You can't take someone to court, because they said something once.
