GUILTY NY - Garnett Spears, 5, dies of salt poisoning, Chestnut Ridge, 23 Jan 2014

  • #481
]Will there be anybody who will attend the parole hearing(s) to speak for Garnett [/U](assuming that such a thing is allowed in NY) -- and to plead that LS be denied parole? That's a long time from now. Are there caring family members? Garnett was so young, he may not have been able to meet and make impressions on many people. It's worrisome, IMO.

I think we have heard about members of Sharon Tate's family always being present at parole hearings for the convicts involved in the Tate/LaBianca murders. And they are still in the slammer.

Yes, a premature worry, but that's me all over, folks. Just wonderin' and SMH...

BBM:

Greetings & salutations, ALL! This is my first opportunity to respond to the sentencing, DH did attend (for some damn reason, the "bad" guys & gals in my jurisdiction thought this week was multiple murder/killing week, so I had to work!:tantrum: ) and he indicated that 1. there is a collection of documents that remain in the prosecution file that "goes with" the convict as a sort of "employment record/jacket" and these documents are itemizations, opinions, statements and behavioral facts supporting the denial of parole, 2. documents of healthcare professionals who treated & fought for GS are present, again supporting the denial of parole and 3. testimonials of public citizens who were effected & affected by the convict's actions & words as she tortured GS, again indicating that parole should be denied as she is dangerous to them. There are members of the LE communities who anticipate attending any future parole hearings to speak against release and possibly other community members.

IBM:
The "caring family" were ready to storm the courtroom with victim statements FOR the convict, essentially AGAINST Garnett (NO, "they" never worded it that way but that's EXACTLY what it would be) and at the sentencing, thus the PROSECUTION team spoke for THEIR VICTIM, the "loving family" provided letters to the Court for the convict to receive leniency!

It appeared to DH that the convict was pissed over the sentence, angry "big time" over the Judge's comment regarding "mental illness", and acted like this entire experience was a major inconvenience to HER! He was told that "in -holding" she pitched a hissie cause she was hustled off so quickly (the command: "step RIGHT" was for HER & expected to be obeyed immediately), that the female guards were "pushy" & LS expected to "chat" with her lawyers (GOSSIP: she was very very fond of the tallest one, looking up with doe eyes & "adoration", she was NOT pleased that her suit jacket was wrinkled (& polyester blend, I bet!, thought the "attendants" (guards!) crushed it ).

Her lawyers were stunned over the MSBP comment as it was NOT mentioned in trial BUT (GOSSIP: the Judge stated to DT & PT after that he had done HIS research & he stood by HIS comment that one need NOT be a "shrink" (in court he used the professional term, psychiatrist :happydance:) and that HIS comments were HIS interpretation & advice, not judicial case law!).

Glad to hear these things Joypath!

Joypath-- do you have any insider or local info about Bedford Hills Correctional Facility?

I know LS will be in an intake situation for a few weeks while they do evaluations and testing for placement. I'm guessing it's possible she could be in a single cell for a while due to her notoriety and for her own protection? Any info on what her life will be like behind bars? She won't be eligible for those family centered programs and therapies, obviously-- since she killed her only child.

As I wrote upthread, Bedford Hills appears to be a "pretty good" prison for women, as prisons go. It looks like she could earn a community college degree, among other programs.

Many thanks, joypath, for those encouraging words. This crime, IMO, would certainly be among one of the worst certainly because it was done to a helpless, trusting, dependent individual who was an infant, later a toddler, then a child, and because it was done time after time after time. There's no way, IMO, a fair-minded judge or Parole Panel could allow this woman parole after just 20 years even though she might have been a "model prisoner." We'll have to wait & see on that "model prisoner" part.... She hasn't had a good start, judging from her actions immediately after her sentencing... Keep it up, Lacey! :jail:

I did so like to watch her stumble as the guards yanked her away from her attorneys who, btw, did not seem eager to continue speaking with her. I be they didn't like her! Anyhow, I saw how she tried to stay and chat but the guards weren't having that and immediately hauled her away as an outraged look crossed her face. Love it.

Bedford Hills Correctional Facility: yep, a MAXIMUM prison for women and as K_Z aptly noted, probably one of the "best" as prisons go! There are many progressive concepts that have been/are being utilized there and from my perspective, helping to make positive strides for those women who WANT & WILL work the programs.

Yep, the convict will be processed thru the typical intake system: no matter what her "jacket" says currently, EVERYTHING will be re-evaluated & documented, now in the BHCF format & according to the NYSDCCS standards. It is my understanding (from folks @ my jurisdiction who have contacts) that she'll be basically in a short-term self-confined area (a "private room", a Jodi might spin it!), under close watch but NOT suicide unless necessary and in the older section of the prison. She will NOT be eligible for inmate programs immediately (so a Marymount degree will have to wait :shame:), nor will she be in contact with the infirmed or children (thus her other "volunteer talents" from the religious NY community where she lived will NOT be "put to good use" :moo:).....these limitations on her are because of the nature of her crime :drumroll: (violent, against a child). :drumroll:
Most of the individuals are housed in single cells but not solitary confined area, if she doesn't integrate well......she will be in a "close-watch" area OR given her ?notoriety? (not sure if applicable 'cause there really wasn't a huge "hue & cry" about this case!), she'll be in an administrative segregation section.

She has 19 years of confinement BEFORE she can request a parole hearing! :jail:

The "campus" grounds are actually quite spacious, well groomed (inmates MAY participate in gardens, not required to perform manual labor unless so desired), there are athletic areas (appeared to be similar to perhaps a "town park" vs a glorious HS/college environment!). There is a HUGE buffer zone of trees (like the deep woods!) that keep the society of Bedford Hills & even the Interstate highway out of sight of the prison! There is a HUGE emphasis on education and self-development, again voluntary programs EXCEPT one must achieve a GED if needed.

Inmates with professional skill sets MAY teach but that's an "honor" offered after the inmate has had good behavior demonstrated over a LONG period! EX. Jean Harris (the "diet doctor" killer) established a few reading & mentoring programs, she used her background as a headmistress of a private high school to uplift the inmates, meanwhile she said that she discovered another society of valuable people who taught HER!.

I'd be a little worried she might poison whatever was growing in the gardens. Probably another job she shouldn't have. Hope they think of that. Especially if they are growing fruits/vegetables!

Was this captured on video? I'd like to watch it.

Here is a link to the local LoHud article, which has been updated with 3 videos embedded. The first one is the judge's sentencing remarks, which cut off before she is escorted out. (I'll find an extended video, because I saw it, too. ) Second video is defense attorneys giving a press conference after sentencing. Third video is prosecution remarks at sentencing.

This video shows her leaving the courtroom. Rather abruptly. Also note she was handcuffed for sentencing.

And regarding the appeal and her defense attorneys, doesn't a convicted person usually have different attorneys for the appeal process? Appeals are a specialty area of the law, as I understand it.

ETA: the second YouTube link above addresses that when the clerk reads the appeal instructions to her. She will have a prison attorney for the appeal. So I'd guess her privately retained attorneys Sachs and Reibling may be finished with her case.

BBM:

It was a surprise to those in the courtroom that the 2 current attys had the appeal paperwork ready to go & handed it over even as LS was leaving! Not sure if they will stay the course with her, however (really, WHO would want to endure more of the convict!)

AZLawyer does appeal work and has told us that it is a separate specialty. Lacey will get different lawyers to work on her appeal, just as Jodi Arias will and Scott Peterson did.

So much for her crush, she won't be seeing them again!

Not premature. I had the same thought. I hope parole fails over and over for a long time.

Given the judge's comments, I suspect a parole board might not be too sympathetic UNTIL and UNLESS she shows remorse and insight into her actions that caused Garnett's death. That would require her to admit what she did. So time will tell whether she continues to deny her responsibility, or whether 19 years of prison persuades her to confess, accept responsibility, and seek whatever help is available at Bedford.

I doubt her conviction would be overturned on appeal. That's part of the strategy of the second degree charge versus first degree, as I understand it.

And neither will we. :(

Those 2 are definitely easy on the eyes! Sachs, the shorter one, reminds me of a pilot I dated while I was on active duty. But that's obviously pretty far off topic. ;)

Lacey Spears joins list of notorious killers at prison

WHITE PLAINS, N.Y. — Inmate 15G0289 walked through the doors of Bedford Hills correctional facility Monday for the first time to serve a 20 years to life sentence on murder charges.

Convicted of poisoning her 5-year-old son, Garnett, Lacey Spears, 27, will join a notorious list of fellow woman killers at Bedford Hills, including multiple child killers:

New York Dept of Corrections look up: Inmate 15G0289. She arrived to her new home 4-13-15. Eligible for parole 6-12-2034. Can't find a new mug shot.

Wonder if she'll meet up with Stacy Castor, who is also housed there. She poisoned two husbands and her daughter, and attempted to pin the husbands' deaths on the daughter, but fortunately the daughter lived. Maybe they'll poison each other...

  • #498
Does anyone have a link or access to the video of Lacey and Garnett in the hospital when she's seen taking him into the bathroom to poison him? It's talked about that it was shown in court and happened a couple of days before his death, but I haven't been able to find it.

ID channel's series, "Web of Lies" recently did an episode about this case. They interviewed a friend from Florida who talked about how Lacey lied and claimed Garnett was the result of incestuous rape. Also, you could see how the detectives were really haunted by the case. So tragic.

I saw it! Don't normally watch that show but I wanted something on late night and that was it.
