The Ghislaine Maxwell jury questionnaire, which is now out, perfectly illustrates the "Streisand effect." There was little in it that is new or newsworthy, save for the fact that her defense team wanted to seal it.

Draft questionnaire attached. No idea why they wanted it sealed, I was looking for a "whoa" question but it just seems like standard fare IMO.

The headline is confusing. The 2009 settlement involved JE, not PA. Looks like it's up to the original judge on whether to unseal the document.

The settlement agreement was reached between Giuffre and Jeffrey Epstein,...

...Kaplan seemed to urge the parties to ask the judge in the other case - Loretta A. Preska - to agree that the document can be unsealed, saying Preska 'might well view with favor an application... to permit the public disclosure of the Settlement Agreement.'

'But that is for her to say,' he wrote, ruling that the agreement can be filed under seal and remain so unless Preska and Kaplan decide otherwise.

New: Prince Andrew's defense team notifies the court of its "constitutional challenge" to Virginia Giuffre's lawsuit. His lawyer claims that the New York Child Victims Act "impermissibly revives the statute of limitations" in violation of his due process rights.

"In court documents filed in US District Court in Manhattan today Andrew, 61, urged a US judge to dismiss her lawsuit, calling the claims 'baseless' in an effort to 'achieve another payday'.

The prince also cited a damning story published in the New York Daily News in 2015 that revealed 'Giuffre also was trained to and did, in fact, recruit other young women into Epstein’s sex trafficking ring'.

One of Giuffre's ex-lovers who would drive her to Epstein's Palm Beach mansion told the news site: 'She was like head b****.

'She’d have like nine or 10 girls she used to bring to him. She never looked like she was being held captive... She and the other girls would walk out of there smiling, with their little bathing suits on, like they had just come from the beach. She’d have like four grand. 'And then I’d take them all to the mall and they’d get their nails done.'

... for over a decade, Giuffre has profited from her allegations against Epstein and others by selling stories and photographs to the press and entering into secret agreements to resolve her claims against her alleged abusers ...

Although it is unclear how much money she received ... the compensation was reportedly worth more than $121 million.

But it still doesn't change the fact that she was a minor!

This is true. She was involved with a child trafficker at age 13. Her father helped her escape from that life. At age 17 she was involved with a different child trafficker as a recruiter of children for a pedophile.

According to human rights, anyone who is under the age of 18 and who recruits children for a pedophile cannot be held responsible for her actions if she was previously trafficked. I believe that applies to the same trafficker. The very unusual situation of being trafficked by one man, escaping that world, then returning to trafficking for a couple a few years later as a recruiter, is not addressed.

The question of whether she recruited children for a pedophile after she turned 18 year old is not yet clarified, although I expect Prince Andrew's lawyers will address this point.

I'm trying to understand the legal arguments.

So Guiffre signed a deal with Epstein in 2009 agreeing that everyone she met through association with Epstein was absolved of accusations from Guiffre? On that basis she received a lot of money?

Then there was a recent change of law in New York that extended the timeline for accusations of sexual abuse? That now included the time that Guiffre met Prince Andrew 20 years ago?

She initiated a lawsuit against the prince, using the photo as proof that they met under comfortable circumstances. I'm assuming that if Prince Andrew had just raped, or intended to rape, the woman in the photo he would have declined the photo. Regardless, she has a photo taken in London when she was 17 years old where the age of consent is 16. It is not enough to claim "age" as denial of consent.

The 2009 document is sealed was sealed. First, Prince Andrew wanted it unsealed to check whether it was relevant. Second, Prince Andrew requested that the document remain sealed and he's using the document to have the case dismissed. Apparently Alan Dershowitz used the same argument and then sued Guiffre.

Am I understanding correctly? I don't know what to make of it, but I'm curious to understand the legal arguments.

That's true. He claims to have no memory of ever meeting her, and suggested that the photo is fake. This isn't all that surprising. As a Prince, he has met many people throughout the world throughout his life, and has probably posed for thousands of photos with people that he does not know and does not remember.

According to the affidavit filed by Prince Andrew, the age of consent in New York is 17. That means that Giuffre cannot state age as a reason that she did not, or could not, consent.

The affidavit is well worth reading, as it documents the changing story, how Prince Andrew's name was slowly introduced by Giuffre until she included rape, Giuffre profiting from the story, vagueness of facts, nature of Giuffre's relationship with Epstein, and legal documents preventing Giuffre from accusing associates of Epstein of any wrongdoing.

Some will choose to believe that Alan Dershowitz used a technicality to have the accusations from Giuffre dismissed, but that he is in fact guilty. Some will choose to believe that Prince Andrew is using the same technicality. However, it should be recognized that this "technicality" is in fact a signed legal agreement by Giuffre in 2009. It is not a legal loophole.

Every story has two sides, and it seems that Prince Andrew is finally telling his side of the story.

"When Giuffre was in the middle of settling a lawsuit with Epstein in March 2015 former friends even claimed that despite her accusations that the financier was keeping her as a sex slave, she was actually more of a 'money-hungry sex kitten' who enjoyed the lavish lifestyle.

The court documents went on to point out that 'for over a decade, Giuffre has profited from her allegations against Epstein and others by selling stories and photographs to the press and entering into secret agreements to resolve her claims against her alleged abusers, including Epstein and his ex-girlfriend, Ghislaine Maxwell'.

The court documents also said that Giueffre has created 'a media frenzy' in the press, which has led 'sensationalism and innuendo (to) prevail over truth'.

Another lawsuit has been filed against Giuffre for defamation and slander against one of Epstein's victims.

"A woman who accused financer Jeffrey Epstein of sexually abused her has sued another Epstein accuser [Giuffre] for defamation and cited a series of year-old tweets.
...

Oh said authorities, including the FBI, have agreed that she was a young victim of Epstein's 20 years ago and not a co-conspirator or part of his inner circle - which Giuffre has been accused of being.

Giuffre asserted in a series of October 2020 tweets that Oh was Epstein's girlfriend and recruited girls for him to abuse.

Another tweet cited in the lawsuit said Giuffre accused Oh, an artist from New Jersey, of leaving a six-inch scar on her leg from one of their encounters two decades ago.

However, the lawsuit claimed that none of that was true and Giuffre 'has maliciously reiterated and republished these defamations and slanders in prior and subsequent tweets and interviews on podcasts, TV and for magazines, as well as in her memoirs entitled Billionaire's Playboy Club."
