Orlando's Tercero's murder trial is in Nicaragua, but Binghamton provides grisly details

On Friday, the second day of Tercero's trial in Nicaragua, prosecutors used testimony from Binghamton police officers to outline their investigation of the crime scene. Some of that included security video clips from outside Tercero's residence, which captured his movements after the murder.

The trial is unfolding for members of Anderson's family and her friends on a livestream video played on a large screen at the Broome County District Attorney's Office grand jury room in Binghamton. On the other end of the building, witnesses are testifying in the DA's office, aided by Spanish-language interpreters in both countries.

The Nicaraguan court is dictating the course of the trial, asking the Broome County DA to provide witnesses upon request. The first day of testimony spanned all day Oct. 1, but the judge did not reconvene the trial until Friday.

A verdict in Tercero's trial will be decided by the Nicaraguan judge, and the trial will resume Oct. 22.

9/9/19: Appeared in court. Trial set to begin 10/1/19. Eight witnesses are scheduled to testify against him, including Anderson’s parents & ex-boyfriend.
10/1/19 Day 1: Several witnesses testified (Karen Anderson, Haley's mother. Josephine Artin, Haley's friend mentioned in article). Trial continues on 10/4. No trial today, continued to 10/11.

Binghamton Police Officer Kristy Sager. Dr. James Terzian, a pathologist at Lourdes Hospital in Binghamton. The Nicaraguan court is dictating the course of the trial, asking the Broome County DA to provide witnesses upon request. Trial resumes on 10/22. At that time, the defense is expected to submit evidence regarding Tercero’s mental state, including a psychiatric evaluation.

Orlando Tercero Trial's Rare Place in the Legal World


Witnesses have gathered in Binghamton over the past three weeks to testify in the trial of a man accused of strangling a young nursing student. But there is no jury, no American judge and the man accused is seated next to his defense attorney 2,200 miles away — in Nicaragua.

In an exceedingly rare legal proceeding, the trial of former Binghamton University student Orlando Tercero in the 2018 killing of 22-year-old Haley Anderson is taking place at a court in Managua, Nicaragua, with a Nicaraguan prosecutor and a Nicaraguan judge applying Nicaraguan law.

American prosecutors have no authority over the trial, but the Broome County District Attorney's office in New York is deeply involved as a facilitator for witness testimony. The witnesses have testified, with the help of a translator, via a video link from a room in the district attorney's office in downtown Binghamton.

Meanwhile, Tercero's trial began in Nicaragua earlier this month and has included two days of testimony so far. There is no jury and the verdict will be decided by a judge.

Lawyer Prepares Psychiatric Defense For Orlando Tercero, Accused Of Killing BU Nursing Student Haley Anderson

On Tuesday, prosecutors rested their case against Orlando Tercero.

..... The last witness for the prosecution was a member of the Nicaraguan National Police who was involved in capturing Tercero after Binghamton police say he fled the country......

After only an hour of testimony, the judge adjourned the trial until November 1st, giving the defense time to prepare their first witness. This witness is expected to be the doctor who performed a psychiatric evaluation on Tercero shortly after he was captured in Nicaragua.

U.S. Again Requests & Denied Tercero Extradition to Broome County


The trial of a former Binghamton University student accused of killing another student in Binghamton then fleeing to Nicaragua is again adjourned for several days and a key request is again denied.

October 22nd’s proceedings in a court in Nicaragua with a streaming link to the Broome County District Attorney’s office in Binghamton lasted only about an hour with the prosecution wrapping its case and the United States again requesting that Tercero be extradited to Broome County to face murder charges in the death of Haley Anderson in March of last year. Again, that request was denied by the Nicaraguan judge.

Haley Anderson’s parents speak out for the first time after Tercero conviction

BINGHAMTON (WBNG) – Moments after a Nicaraguan judge handed down her guilty verdict in the Orlando Tercero case, the parents of the woman he’s now convicted of killing are speaking out.

The court proceedings, which began October 1, were interrupted by an earthquake Friday.

Tercero was found guilty of femicide which is known as homicide in the U.S.

He could face a maximum of 30 years in a Nicaraguan prison.

No word right now on when that sentencing will happen.

Tercero has the right to appeal but regardless of that appeal, Tercero still faces a second degree murder charge charge, and there’s a warrant out for his arrest in Broome County.

Citing Judge María Fabiola Betancourt, a prosecution official said sentencing for Tercero would be held within days.


Anyone think it "might" be tomorrow, Monday the 4th? That's "within days"... :D

Haley Anderson's killer gets 30 years in Nicaraguan prison: 'Justice has been served'


On Friday, a Nicaraguan judge sentenced Tercero to 30 years in prison, the maximum penalty under that country's law for femicide, in Anderson's death.

The Nicaraguan judge told the courtroom all women have the right to life, and in a stinging speech before delivering the sentence, she said evidence had proven Tercero took it upon himself to "punish" Anderson simply for rejecting him.

The judge could have sentenced Tercero to at least 20 years behind bars. Her decision to deliver the maximum penalty sent a wave of relief fell upon the face of Karen Anderson, Haley's mother, who watched the livestream in the DA's office.

Overcome by emotion, Karen said, "I think justice has been served to the best that it could've been."

Similar to the American trial system, Tercero has a right to appeal the conviction and sentence. There was no timetable announced Friday for how long that process could take in Nicaragua.

Cornwell said Tercero will get some credit for the 1½ years he's spent in jail awaiting trial, and his prison term will include some counseling.

A second-degree murder charge against Tercero remains open in Broome County.

But Tercero holds dual citizenship. and Nicaragua's government has declined to extradite him.

The murder of Haley Anderson: Binghamton University student's killing profiled on 48 Hours

Binghamton University nursing student Haley Anderson's murder at the hands of classmate Orlando Tercero, who's serving 30 years in a Nicaraguan prison, will be profiled Saturday, April 25 by 48 Hours on CBS.

The show, which airs at 10 p.m., will delve into how fellow BU students remember 22-year-old Haley, their discovery of her body in Tercero's bed at his Oak Street home in Binghamton, New York, the morning of March 9, 2018, and efforts by law enforcement to track down Tercero after he flew to Nicaragua.

After Nicaragua declined to extradite Tercero, the 23-year-old former BU nursing student stood trial there on a femicide charge. The judge who found him guilty handed down the maximum prison sentence.
