Garcia cross examining Kevin Powell: Picture shows Jen's body. No carpet around body or in the area ----- Phone was placed, not thrown ---- Cops looking for vehicle and not a phone at that point in time ------- Why didn't Kelly drive 23 through town instead of Country Club Road? KP: Because it is a quicker way to get around town --- Therefore she would not have gone by Plank Manor ------ Kelly saw leg and breast sticking out of snow, That's how she knew it was human and not animal --- Garcia asked about a tote in the area ???? ----
Witness #9 ~~ Kevin Powell - CCSD Detective with CCSD 15 years -----
Was called to the location of the phone ---- Picked up phone and bagged it and put into patrol car ---- Went to Remy to talk about missing clothes, A get-away bag, Signs that Jen might have left on her own.... No clothing gone, No get away bag gone.. No sign that Jen had left Remy & Kids ------ RR admitted to 10 month affair with E.S. ~~~~~
RR offered Jen's computer and the passwords to FB & Phone --------- Saturday the 15th was another police interview and was more worried about the public knowing about affair more than finding Jen ---- Very calm interview with Powell ---- 12/11/12 ---- Remy makes mention of Jen initiating sex that morning. Said they woke up about 5:30 AM. Jen made school lunches --- RR took kids to school and Jen was eating breakfast cereal when he got back - Jen them went down to work out for about an 1 to 1 1/2 hours (basement) - Showered and went shopping -- RR said he was "****ING pissed" about Jen playing online games -- Remy did not say she was playing games the morning of 12/12 ---------------
Exhibit 208 = CD of conversation at police station with RR & Powell ---- ES took Remy home from Y but did not go in for sex as it would have been normal..... Sent Jen another text -- Walked the dog -- Got after school snacks ready ---- (( RR Fake Cry - No tears ))
She might have had $350.00 in cash ---- She would not steal from Remy she had her own account ---- The cops learned about the affair from the public before RR told them ..........Claimed Pat knew nothing about affair .... Never cheated on Jen, Never had sex until after Jen's body was found in March -- Would Jen pick up a hitch hiker? Depend but yes she would ------ Took no medications with her when she reportedly left ----- Took RR about 10 minutes to find the phone as he kept playing the signal tone and finally hear it ---- RR talked about signal moving from place to place (((( due to poor signal we have learned )) ----- RR asked how many know about ES -- Powell - Quite a few - RR WOW ------- Powell looked through Jen's phone for Touch App & Text ---- Had NEW text from Houston "" "Where did you go - did you leave game?" -- She never said goodbye as normal ~~~~ 12/17/12 RR signed to have house searched ----

Asked Powell what he reviewed before testimony today --
Asked if Powell read the private calls from Remy to Garcia - Judge said (irrelevant ?? ) that they were looked at ------ Wants to see the notes that were taken during the investigation.. (wanting to say he took very little notes during investigation and made reports from memory only). Four pages of notes for the whole investigation taken by Powell. How many times did you listen to the CD to prepare for today" - KP twice before today. Once last night and once this morning.
KP did not tell Remy he was being recorded but that's standard practice for KP. Does not need to tell a NON-suspect at that time. RR volunteered info about affair. KP did not know about it before Remy told him.
RR Welcomed KP to collect whatever he wanted from the house to help the cops -- Was not a suspect at that time - Cooperated with Police all the time -- Gave running clothes without warrant because he was willing to do whatever he can to help.
KP opened text from Rob Houston and Garcia says the message was tainted. KP opened Touch & Kick Apps on Jen's phone and text people in her game to ask for Jen's whereabouts. KP did not request records from App company - He took the records from Jen's phone on his own (Garcia trying to say tainted again). KP was told by undersheriff to bring RR in to get his story on paper. RR asked KP to keep the affair a secret from public. RR said affair was over and ES went back to her husband, Pat.
KP asked if Jen took money to leave. RR said she was a drug addict.

2/26/13 Chen. County asked for Dr. to do autopsy. Jen's skin was turning gray and black. Skin was coming off of her body. Animals had gotten to her. Left side of face showed evidence of trauma by animals, along with with eye socket, left lower leg, right thigh. Her body body was frozen.
Injuries :: Bruises on top right forearm , right thigh and leg
Cut :: 1/4 left thumb / 2 inch bottom of left foot
Internal exam :: Bleeding under back of skull (between skin and skull) 2 inch ball (hemorage??) across the back of her shoulders
Drug testing : Caffeine & (GBH Normal in all people)
NO DRUGS - Prescription or otherwise
Manner of death :: Homicide NO natural causes
Animals start to feed in areas of the body that are already open, such as a cut. Dr. believes there may have been open wounds where they started eating. Blood will continue to drain from the body after death as a hose will drain but not under pressure (so body could have been dead and cut while being put into van and blood would come out of said cuts).
