Judge to weigh evidence allowed in Ramsaran trial

NORWICH — A hearing expected to determine which prosecution evidence will be admitted and which will be suppressed was completed Tuesday in the case of accused murderer Ganesh “Remy” Ramsaran of South New Berlin, charged with killing his wife, Jennifer, during a time when he had been having an affair with her close friend.

The courtroom where the daylong hearing was held — with Ramsaran, 39, in attendance — was closed to the public and press by Chenango County Judge Frank Revoir.

In so ruling, the judge stated in his decision that “after considering all of the arguments of counsel and conducting my own independent legal research, the Court has reached the conclusion that in this particular case, that Mr. Ramsaran’s right to a fair trial would be compromised were the Court to have the pretrial hearings published and subject to public viewing. Particularly due to the high publicity that this case has encountered.”

In New York, the public has a presumptive right to attend judicial proceedings, and the judge’s decision was protested by a reporter for The Daily Star to the state Office of Court Administration.

A spokesman for the agency, David Bookstaver, said after conferring with Revoir that the judge believes Ramsaran’s right to a fair trial trumps the right of the public to attend the hearing. Bookstaver said Revoir explained he was basing his decision on the “unusual circumstances,” noting the case against Ramsaran is based on circumstantial evidence. Ultimately, he added, the judge felt the defendant’s right to a fair trial “trumps” the right of the public to attend the pre-trial hearing.

The request to close the courtroom came from Ramsaran’s new defense lawyer, Gil Garcia. Chenango District Attorney Joseph McBride took not position on the closure, though did ask that the parents of the late Jennifer Ramsaran, Thomas and Carol Renz, and the sister of the alleged victim, Joann Buff, be allowed to attend the proceeding. Revoir granted that request, and the family members were ushered into the courthouse while the reporter remained in a downstairs lobby.

In his closure decision, Revoir expressed concern with the considerable amount of attention the case has been getting in both the news media and on a social media page known as “Justice for Jennifer.” Carol Renz and Joann Buff are among the scores of people who have posted comments on that page.
Ganesh Ramsaran was also involved in publicizing what he called his wife’s unexplained disappearance in December 2012, granting numerous interviews, including several with The Daily Star, before his wife’s body was located 2½ months after he reported her missing. her .

Jury selected, Ramsaran's parents speak out

A final jury of nine men and three women was chosen Wednesday at Chenango County Court in the murder trial of Ganesh Remy Ramsaran.

The attorneys still need to choose four alternate jurors. A pool of 100 potential jurors has been called for 9:30 a.m. Thursday.

• Jason Wicks of Alabama took the stand first, and said he and the defendant have been best friends since 1996. Wicks said while the Ramsarans were living in Arizona, they visited each other multiple days per week. “His (Ramsaran’s) relationship with Jen was great.”

A prosecution witness in the case of accused killer Ganesh “Remy” Ramsaran acknowledged Monday she had sex with the defendant one day before his wife, Jennifer Ramsaran — her best friend — went missing from her South New Berlin home under suspicious circumstances.

Eileen M. Sayles, 36, of Norwich said she was a mother of two when she first met the Ramsarans in 2006 through the involvement of their children in the local Girl Scouts program. Her friendship grew stronger later with Jennifer Ramsaran, she said, even as she began what she described as a passionate affair with Ramsaran’s husband, a work-from-home program manager for IBM, in February 2012.

Girlfriend Testifies in Ramsaran Trial

Testimony continued today in Norwich in the trial of Ganesh "Remy" Ramsaran, the New Berlin man charged with second-degree murder in the death of his wife Jennifer in December of 2012.

A number of witnesses were called to the stand today, including the vicitim's mother, a State Trooper, and two officers from the Chenango County Sheriff's Office.

In the afternoon Ramsaran's girlfriend Eileen Sayles offered emotional testimony.

Prosecution presented evidence containing emails and text messages between the two. Sayles admitted to the prosecution about their, affair noting that Remy's wife Jennifer was not aware of the relationship. Sayles says she maintained a close friendship with Jennifer, often talking and shopping with her.

During cross examination the defense also mentioned the arrest of Sayles. She admits she was arrested by the DA for contempt of court; stating that she was not aware of the summons process and she did not wish to testify.

A detective from the Chenango County Sheriff's Office was on the stand for about four hours Tuesday.

The jury listened to a recording between the detective and Remy Ramsaran.

Phone call records were presented by prosecution between the dates of May 28, 2013 and August 29, 2014 from the Chenango County Jail to Eileen Sayles, Ramsaran's then girlfriend.

Records show he tried to contact her 2,483 times within that period.

Lisa Harvey, a receptionist at a law office that specializes in divorce, testified that on Dec. 6, 2012, Jennifer Ramsaran called her office to schedule a matrimonial appointment with a lawyer.

The appointment was scheduled for Dec. 21, but Jennifer went missing on Dec. 11.

Jennifer's online gaming friend Robert Houston testified via video chat from England.

Houston described his relationship with Jennifer as intimate, and said the two were in contact five to six hours every day for the few months he knew her.

Houston met Jennifer online playing the game Kingdoms of Camelot in August 2012.

He testified that Jennifer sent him a "small gift" for Christmas -- a pair of women's panties.

He sent her $150 to buy herself a Christmas present.

Blood found in Ramsaran's minivan, home

New York State Police investigators found multiple blood stains in Jennifer's minivan.

Investigator Jason Miller searched the van and noted small blood stains on the interior driver's and passenger's doors and near the gas pedal, as well as a large blood stain on the floor in the back of the van.

Miller also helped search the Ramsaran's house on Sheff Road in New Berlin.

He noted 12 areas of blood in the first floor hallway and two areas of blood in the downstairs bathroom.

Chenango County District Attorney Joseph McBride told Action News a blood expert and a DNA expert will testify Monday as to whose blood was found in the minivan and house.

Investigators also seized a bottle of spot remover found in the master bedroom, several electronics, rugs and a stained sheet.

Forensic investigator Jason Miller took the stand and told jurors about the investigation into the Ramsaran's vehicle and home.

According to Miller the exterior of Ramsaran's Chrysler minivan was covered with a heavy layer of mud and road dust.

Inside the van Miller says he found small blood stains on the driver and passenger doors as well as near the gas pedal with a larger blood stain in the rear of the van.

Testimony conradicts Ramsaran's police interview

Ganesh Remy Ramsaran told police his wife left to go shopping between 10-10:30 a.m. the morning she disappeared, but testimony Friday showed Jennifer Ramsaran's phone hooked up to their household Wi-Fi at 10:57 a.m.

Director of Security Technology and Global Forensic Investigations for IBM Christopher Roper testified on Friday. Roper examined Remy's two work computers to determine when they were in use the morning Jennifer disappeared.

Prosecution asked Roper if there was activity from the laptops, during the times Remy told police he was working, when his wife left to go shopping.

"The two computers were sitting idle at those times," said Roper.

Forensics Examiner Testifies About Sexual Photos in Ramsaran Trial

More prosecution witnesses testified in the murder trial of Ganesh "Remy" Ramsaran, charged in the death of his wife Jennifer in December of 2012.

Nude photos seemed to be a hot topic in the courtroom today -- during the testimony of Carl Smith, a forensics examiner of the Binghamton Police Department.

Smith said he searched several electronics devices including the Ramsaran's computers, a laptop and cell phones. Smith said on the computer he found lewd photos and videos of Remy and Jennifer Ramsaran.
