Does anyone think that the DA's office is going to continue with the absurd "argument over cigarettes" motive?

I will be very disappointed if Dilione is not also charged with murder. Obviously there is a lot we don't know, but at a minimum he was involved in a physical altercation with the victim that led to his death, not to mention his hand in disposing of his body.

James Rackover, 25, and his friend Lawrence Dilione, 28, will face second-degree murder charges. Rackover and Dilione were also charged with hindering prosecution, tampering with evidence and the concealment of a human corpse.

Max Gemma, 29, will face charges for hindering prosecution and tampering with evidence.

All three men are due in court on May 19

Dilione had been free on $300,000 bail prior to the new indictment — and still partying, according to prosecutors.

“We have obtained information that while this case was pending he continued to use illicit drugs including cocaine,” assistant disctrict attorney Antoinette Carter said.

Btw, I love that despite Dillione's admission that he hit Comunale so hard that it knocked him out, his lawyer is adamant that he had nothing to do with the murder.

Defense Lawyer Michael Pappa made a lengthy bail argument, asking Justice Charles Solomon to release Dilione on $2 million bond backed by the property of his parents who were in the gallery.
He said that bondsman Ira Judelson was even prepared to fit Dilione with an ankle monitor to secure the arrangement.
“I feel certainly bad for his family,” said Justice Charles Solomon as the victim’s father, Pat Comunale, softly sobbed. “But I feel a lot, a lot worse for the parents of that young man who was killed.”


The judge ordered that Dilione and Rackover, who describes himself as the adopted son of jeweler-to-the-stars Jeffrey Rackover, be held without bail.

wow I was just thinking along same lines (no pun intended!) ... but looking back at the photos from the night of the arrest (re: LD "grimy" black sweats), he looks so wacked... I'm sure he looks like that for a number of reasons, but I see that washed out post-binge look...
