GUILTY NY - Joshua Niles, 28 & Amber Washburn, 24, Shot to Death, Sodus, 22 Oct 2018

Annnnd we're back.
Here's a bit of pool footage (no audio) from opening statements on Monday. I'm working on a video (which takes time, and I've had very little to spare the last few days) but I thought I would share a work in progress so you can better visualize the courtroom.

(video clip: Georgie Silvarole on Twitter )

Georgie Silvarole‏Verified account @gsilvarole 6h6 hours ago
Apologies for fuzzy footage. Internet is subpar in court, so I had to export video at a lower quality to upload it. Still felt it was worth sharing, though.
You'll see ADA Christine Callanan (right), defendant Tim Dean (far left, has a beard) and his attny Damelio next to him.

Georgie Silvarole‏Verified account @gsilvarole 6h6 hours ago
More on that later.
Up now: witness Richard Hoepfl, who works with the Monroe County Crime Laboratory. Expertise in weapons collected as evidence.

Georgie Silvarole‏Verified account @gsilvarole 6h6 hours ago
Also, one juror was dismissed. Judge Barrett informs the jury that the juror was dismissed and that they should act as if it never happened and not speculate as to why.

Georgie Silvarole‏Verified account @gsilvarole 6h6 hours ago
Back to Hoepfl: We're taking about the 13 cartridge casings found at the crime scene. He's explaining how they determine if they were all fired from the same gun: by identifying the caliber, firing pin impressions and ejector marks.

Georgie Silvarole‏Verified account @gsilvarole 6h6 hours ago
All 13 were fired from the same firearm, a 9mm Winchester, he says.

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
Now talking about bullets and bullet fragments collected from the scene that Hoepfl examined.

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
Some bullet fragments are damaged to the point where it is difficult or impossible to identify a weapon that they were fired from.
That said, he said was able to identify five bullets from the scene that were all fired from the same firearm.

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
Damelio's turn. Asking about how many bullets, cartridge casings and guns Hoepfl examines in the course of a year. "Thousands, thousands, hundreds."

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
He's asking about Hoepfl's process for examining bullets, bullet fragments, casings, etc. Also asking about gunshot residue (Hoepfl said he did not conduct any gunshot residue testing).

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
Damelio asks about how he'd conduct a gunshot residue test on clothing (by looking at it, using microscope and chemical testing). He did not perform any clothing gunshot residue test in this case, he says.

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
Damelio is confirming how common/popular 9mm Glock and Winchester firearms are. Very, Hoepfl says. Thousands produced each year. He's dismissed.

Up now is Colleen Murphy, who works at the Monroe County Crime Lab as a forensic biologist.

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
inserting my own commentary here: so interesting to watch people who know how to testify v. people who have never testified in their lives. I've seen both this week, and it's fascinating.

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
Colleen Murphy, for example, just said she's testified more than 30 times. You can tell. She answers questions quickly, succinctly and does not stray from what the question asked when providing her answer. She also looks directly at the jury while she speaks.

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
Back to the trial: Callanan has given Murphy a bag with evidence sealed inside. Murphy is putting on gloves and has been asked to open the bag and identify the contents without touching them.
It's the balaclava.

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
She's explaining how she collected "trace evidence" from the balaclava. Then she used a crimescope (similar to a blacklight) to see stains like saliva. She identified two stains, one on the nose area and one on the mouth area.
She photographed them, then cut and removed them.

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
The pieces she removed were then preserved for DNA testing. Callanan has no further questions.
Damelio's up. He's asking when the last time the Monroe County Crime Lab had an inspection.

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
Asks a little bit about the fibers she collected, if she saw any blood. She says she did not notice any red/brown stains that are characteristic to blood.
She's been dismissed and we're taking a 10 minute break.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Ok, we're back. I'm predicting things are going to get real interesting.
Up next: a pre-recorded video testimony from Robert Visca, a forensic biologist with the Monroe County Crime Lab. ADA explained to me earlier he was going to be out of town this week...

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
...so rather than postpone the whole trial, the judge approved a request to hear his testimony after jury selection last Friday.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Visca is explaining what DNA is, and how DNA collected as evidence is compared to a given sample.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Visca explaining three outcomes of testing DNA for a match:
1. inclusion - DNA consistent btw sample and evidence (match)
2. exclusion - DNA inconsistent btw sample and evidence (no match)
3. inconclusive - lack of quantity or multiple contributors in a sample (can't determine)

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
In the video, Callanan shows him the 2 pieces of stain evidence collected from the balaclava.
She also shows him the DNA reference sample from Timothy Dean.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Visca says he analyzed the two pieces in November 2018.
He matched the stains from the balaclava to two different DNA profiles (a DNA mixture). The major profile, he said, belonged to an unknown male.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
In February 2019, he used the buccal swab taken from Timothy Dean and analyzed and tested the DNA, he says. He compared Dean's DNA profile to the major profile found on the balaclava.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Visca says the probability of the DNA from the ski mask found in Sodus not being Dean's is approximately 1 in 14.3 octillion. (That's 27 zeroes)

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
1f4a5.png
This is key evidence. This places Tim Dean (or at least his DNA) in Sodus, right near Josh Niles' house. That said, the evidence tech who testified the other day said it was impossible to determine how long the ski mask had been on Elmwood Avenue before it was collected.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
In the video, Damelio is asking questions about DNA, how accurate the tests are, how DNA is collected, how DNA can get on other items, how DNA can be transferred, etc.
Before we move on, I want to illustrate the crime scene a bit:

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Here is a map from Google of 29 Carlton St., where Niles and Washburn were shot in their driveway.
Several people testified that the shooter fled west, behind the outbuildings at 29 Carlton St.
The X on Elmwood Ave. is about where the balaclava was found, to my understanding.

D7Mkp57WkAEiVgn.jpg

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Back to the video, which is still playing. Damelio asks more about DNA evidence, and how long it can be present on an item.
Visca says his testing can only determine the presence of DNA, not "when, why or how it came to be on that item."

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Annnd the video is over. That's Callanan's last witness for today. We resume tomorrow at 1:15 p.m. because Callanan has a witness that can't be here until 1:30 p.m.
I'll see y'all tomorrow afternoon!

Timothy Dean's DNA found on ski mask near Sodus double-homicide crime scene

May 22, 2019

"One in 14.3 octillion — that's the probability that DNA recovered from a ski mask found in Sodus doesn't belong to Timothy Dean.

Robert Visca, a forensic biologist at the Monroe County Crime Laboratory, testified that DNA "stains" found on the ski mask were a positive match to a DNA sample Dean provided in January....

The trial is scheduled to resume at 1:30 p.m. Thursday. The jury will hear from a witness who was unable to make an appearance on Wednesday, Callanan said, and could possibly hear closing arguments by the end of the day. "

NBC's Dateline crew filming at Timothy Dean murder trial in Sodus (with clip)

May 23, 2019

"NBC's Dateline is back in in town.

A production crew for the real-life crime television show has been filming at the Wayne County Courthouse since Monday for a potential episode about the Sodus double-homicide trial.

Though the crew filming in Lyons has said it's too early to say when an episode featuring accused killer Timothy Dean and his wife Charlene Childers might air, it's not the first time the show has featured an out-of-the-ordinary homicide in the Rochester region.

Here's a look at some other recent, local slayings that have been featured on Dateline:..."

Welcome back, y'all. It's day four. Couple things I want to talk about before we start. First, a camera crew from @DatelineNBC has been filming for a possible episode — and it's not the first time the show has told an Upstate New York story. Via @vfreile:

Georgie Silvarole‏Verified account @gsilvarole 5h5 hours ago
Second, here's a bit on the biggest piece of evidence yet (in my opinion) that was introduced yesterday afternoon. The ski mask has been in play since day one of the trial, but just yesterday we found out Dean's DNA was on it. More:

Back in Wayne County for Day 4 of the Timothy Dean double-murder trial. The prosecution calling its next witness, Dr. Nadia Granger, the ME in Monroe County. @news10nbc

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
First (and I believe only witness today) is Nadia Granger, Monroe County's Chief Medical Examiner. She's discussing how autopsies are performed.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Granger estimates she's performed more than 2,800 and 3,000 autopsies in the course of her career
1f633.png
And now Callanan is asking her about gunshot wounds, and how they're identified during an autopsy.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Granger's talking about how to tell the difference between a gunshot wound that went through-and-through (both an exit and entrance point) and one that has an entry but no exit point (meaning something was behind where it would have exited, like the ground or a wall).

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Granger performed autopsies on both Joshua Niles and Amber Washburn.
Niles was wearing a gray t-shirt, blue jeans and gray underwear when she performed the autopsy on Oct. 23, 2018. She recovered four bullet fragments from his body during the external examination.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
She observed several wounds:
One in his neck, consistent with a gunshot wound.
One on the right chest: The projectile she recovered hit his rib, his sternum and then his rib on left side.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
One on his right lower back went in, hit his right lower lung, severed his aorta, went through his heart, through the upper part of his left lung and exited between the 2nd and 3rd ribs.
She's listing a whole bunch of other "wounds" and "projectiles."
It's clinical and brutal.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Granger just listed 10 total gunshot wounds. She just testified that there were no other medical conditions that could have caused Niles' death.
We're talking about Washburn's autopsy now.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
When she received Washburn's body, there was a significant amount of dried blood on her face. They had to clean it off to see a gunshot entrance wound on her ear.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
The projectile entered through the ear, went through her skull, through the temporal and occipital lobes of her brain before hitting the cerebellum and exited through her skull.
That was the only sign of trauma, and Granger says that wound killed Washburn.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Damelio asks a couple questions about how Granger determines a gunshot wound to be fatal. Granger has been dismissed, and she was the last witness for the trial.
They've excused the jury and Damelio is now motioning to have all of the charges against Dean be dismissed.

Jennifer Lewke‏ @WHEC_JLewke 4h4 hours ago
The prosecution has rested in the case. Jury being escorted out. Defense asks for a dismissal of the case, claiming the people haven’t proved that Timothy Dean is the man who committed the murders.

Stephanie Golden‏ @SGoldenWROC 4h4 hours ago
Asst. District Attorney Christine Callanan just rested case. Defense Attorney Joseph Dameilo rest his case. Dameilo is now asking the judge to dismiss the charges against Timothy Dean because prosecution identified him as the shooter.@News_8

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Damelio: "The people have failed to identify my client as the person who committed the crime. ... There's no evidence that my client was the person who did it."

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Callanan asks the court to deny Damelio's motion, lists some examples of evidence provided over the last few days. Judge Barrett calmly denies the motion. All very low key. They're bringing the jury back in now.

Georgie Silvarole‏Verified account @gsilvarole 4h4 hours ago
Annnd the jury's shuffled back out again. They'll hear closing statements from attorneys in a little bit -- which we will be allowed to record video and audio footage of. Stay tuned for that later. Judge also asks Dean if he wishes to testify. Dean says he does not.

Breon Martin‏ @BreonMartin 3h3 hours ago
Timothy Dean chose not to testify today.

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Ok, summations are underway.

Kelsie Smith‏ @KelsieSmithWHAM 3h3 hours ago
Damelio addresses witnesses testimony, he points out a contradiction in a neighbor’s testimony - on the day of the shooting she said she didn’t see the shooter’s face - but she later said she recognized Timothy Dean.

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Damelio, to jury: "To convict my client of these charges in this case, you have to believe a liar and a cheat — times two."
"You have to believe a convicted killer." Says if they looked up "liar" in the dictionary, they'd see Childers' photo.

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Damelio: "You all took an oath as jurors in this case. Other people took oaths too. To some people, that oath doesn't mean anything. It's just words."
"As a matter of law, Charlene and Bron are accomplices. ... You have to look at their testimony with a cautious eye."

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Now, talking about neighbor witnesses: "We don't think people are lying here. We think they are mistaken."

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
He says Tiffany Thayer (very first witness, I believe. Next door neighbor who watched the shooting out her kitchen window) did not give a description that day.
"She tells the police that day, when it was most important to catch that person, 'I never saw his face.'"

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
"That's the identification you have to deal with. That's not good, that's not credible. ... When she had a chance to give a sworn statement ... she said, 'You know, I never saw the guy's face.'"

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Damelio is talking about each of the neighbors who testified. Points out that no witness ever said they saw the shooter wearing a black ski mask.
This is true. But each of the neighbors said they only noticed the black hoodie — no one (except Thayer) recalled any face at all.

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Now he's talking about Iacona (the postal carrier). If you recall, she said she saw Dean on Elmwood Ave. near where the ski mask was found.
It's possible Dean could've dropped the mask before she saw him, but Damelio says Iacona could have been mistaken about seeing him at all.

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Damelio talking about evidence collection and mentions that fingerprints were never discussed. On all the casings and fragments collected, no latent fingerprints were brought into evidence. (It's a good point)

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Now, talking about Childers again: "Ladies and gentlemen, she is a made-for-TV movie." Calls her dishonest, cunning, blunt. Talking about how her plea deal gave her something to look forward to: eventual freedom.
Damelio: "Problem: She is incapable of telling the truth."

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Damelio's talking about the love letters again — how Childers wrote Dean 47 letters while her boyfriend, Casey Miller, visited her 61 times in jail.
"She never told her husband about this guy."
Hey @mleonardmedia, are those letters something I can FOIL for???

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Talking about how she went to the vigil at Niles and Washburn's house after they were killed and cried during a TV interview.
Damelio: "She told you she even watched herself on the news the next day. How perverted is that?"

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
"She guaranteed, she ensured, that her kids would never see their father again."
Now talking about Bron Bohlar: "Ladies and gentlemen, he's not going to get the deputy of the year award, I'll tell you that."

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Talked about the cell phones -- how it doesn't prove Dean himself was anywhere, just that the device itself was somewhere.
And talking about DNA -- there were two DNA profiles on the ski mask (including Dean's) but can't tell how long the DNA has been on the mask.

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
He's got a purple glove on now, holding up the ski mask: "Folks, no one testified that the ski mask was ever worn in this case!"
"How'd it get up there? Charlene was up there for a couple of weeks before this happened."

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Says now that the ski mask was never tested for gunshot residue.
Back to talking about Childers: "Who controls all the heinousness that you see? ... Who wants something here? Do I have to say her name?"

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Damelio on Childers' motivation: "More than anything, she wants two things: She wants her kids from Josh, and she wants her Casey."
"Tim? Tim's a blur in her rearview mirror. ... She's like a black widow. She creeps into your life and destroys anything in and around it."

Jennifer Lewke‏ @WHEC_JLewke 2h2 hours ago
ADA Christine Callanan has now begun her closing statement. She points directly at Timothy Dean saying, “this defendant planned the murder of Joshua Niles to help his wife get her kids back” @news10nbc

Kelsie Smith‏ @KelsieSmithWHAM 2h2 hours ago
ADA Christine Callanan says Niles had abrasions on his body because he was as crawling to get away from Timothy Dean while he was being shot. The ME testified earlier Niles did have abrasions, along with gunshot wounds, on his body.

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Callanan's up. Says Niles was executed, and then when Washburn pulled up at the wrong time "this defendant knew he had one more to kill."
Holding up some evidence in envelopes: "All 13 of those casings, all five of those bullets, all shot by this defendant."

Georgie Silvarole‏Verified account @gsilvarole 3h3 hours ago
Callanan: "This defendant, with his wife Charlene Childers and his friend Bron Bohlar, planned to kill Josh Niles to get back Charlene's children."
She's talking about neighbor's testimonies now, saying all evidence adds up.

Georgie Silvarole‏Verified account @gsilvarole 2h2 hours ago
Says that this plan happened in August, when she lost custody and was devastated. Dean flew up to NY to drive with her back to Texas.
"That car ride was when they decided the only option was to get Josh out of the way."

Georgie Silvarole‏Verified account @gsilvarole 2h2 hours ago
Callanan:"She looks out for herself, and she knew that was a card to play: 'We will get divorced unless I get my kids back.' And this man this definitely was willing to do that for her."
"There's no one else, ladies and gentlemen. It was the three of them in this plan together."

Georgie Silvarole‏Verified account @gsilvarole 2h2 hours ago
Points out that, yes, the phone was off on Oct. 22, 2018. But the first call the phone makes when it's turned back on is to Childers.
"The first call he makes, the first connection he makes, is to Charlene Childers. No one else has the phone."

Georgie Silvarole‏Verified account @gsilvarole 2h2 hours ago
She lists all the pieces of evidence briefly: "These aren't coincidences ... This is proof beyond a reasonable doubt." She concludes: "You must find the defendant guilty."

Georgie Silvarole‏Verified account @gsilvarole 2h2 hours ago
Annnd that's it. We're out for the day. Tomorrow morning, the jury will hear final instructions from the judge and then will be tasked with reaching a verdict.

Gooood morning ☀️

It's day five. The jury is hearing final instructions now, and then they'll be dismissed to discuss/determine a verdict.

We've seen a lot of evidence and heard from many witnesses this week. Here's some of what the jury must consider:

Judge Barrett is reading the charges against Dean to jurors and explaining how they must determine if he committed the crimes. There are 6 felony charges: 1st degree murder two counts 2nd degree murder two counts 2nd degree criminal possession of a weapon 2nd degree conspiracy

Anyway, Judge Barrett is still explaining the charges. He's talking about what the criminal possession of a weapon charge actually means, and how they must determine if the defendant is guilty of that charge.

He's now explaining that they have to reach a unanimous verdict and listen to each other, but also that they should not change their opinion just to come to a verdict and end the deliberations.

They are allowed to re-examine evidence and see parts of witness testimonies again, Barrett says. They're not allowed to leave during deliberations, and they'll be provided lunch today.

He's dismissing the three alternate jurors. Thanks them for their time, effort and attention. The 12 jurors who will be deliberating are escorted out of the courtroom. So now we wait. ⏳

Jurors are back, but don't get excited. They've asked to see some evidence again. They just watched some of the body cam footage from Deputy Nicolet that shows Dean next to the rental car in Kansas. Now they're hearing Frederick Plummer's testimony again.

They've taken a few exhibits back with them and left the courtroom. I think one was the overview map of Carlton Street, but not sure. As usual, I'll tweet when we've got anything new going on. See y'all in a bit.

Courtroom's back open. Don't yet know why -- likely the jury is requesting to look at more evidence again.

Yeah, they want more evidence: -Hear Kelly Iacona's statement again (she was the postal worker) -See an overview map of the crime scene area -See a photo of the tote Dean allegedly had with guns in it

Annnnnd they're out again. Back to waiting.
