A lawyer who was caught on camera beating another woman on the New York City subway has broken her silence to defend her actions that were caught on shocking video.

Anna Lushchinskaya, 40, spoke out for the first time since her arrest in the December 11 attack on a Brooklyn D train, telling Inside Edition that she was actually the victim in the incident.

'The video didn't start in the beginning,' Lushchinskaya said of the cell phone video that showed her screaming at 26-year-old Michelle Tung and beating the woman with an umbrella as other straphangers tried to hold her back.

Video from the bizarre incident, shot by podcaster Juan Ayala, does not show what led to the altercation at 7.50am on the crowded train during the morning commute.

When asked by Inside Edition if she was out of control, Lushchinskaya countered, “How am I crazy? I was defending myself to the best of my ability.”

In the video, the Brooklyn lawyer spit at the woman and used a racial slur. She also called a Dominican passenger, Juan Ayala, “Mohammed Atta.” Mohammed Atta was one of masterminds of the 9/11 attacks.

When Inside Edition's Megan Alexander told Lushchinskaya she had offended people with the remarks, she replied, “That is too bad. It’s their opinion.”

I’ve watched this a few times....a while back.
This woman IMO....is mentally ill.

Not wishing to offend but this is used far too many times for bad behaviour. 4 of my grandmothers siblings were manic depressives as she was, and they would never have behaved like this. I also acknowledge it could be some type of mental illness but she just comes over as down right nasty.

So what was she defending herself from?
 
Oh, that poor woman, physically attacked by that lawyer. She has a history of bad behavior on the subway? Why hasn't she been banned for the safety of other riders? I hope the lady she attacked is all right. How horrifying for her.
 
Even if it's true that she was acting in self defence (in my opinion, this is completely untrue), that doesn't excuse or explain the racist slurs she used against the woman and the Dominican bystander. There's no need to defend yourself with vile language. And when the language she used is pointed out to her, she doesn't even apologise?

She sounds like an awful person, imo.
 
I’ve also seen it somewhere that this is not the first time she’d done this aggressive type of behavior on the train.

In June, she was arrested for allegedly pepper spraying a man and woman, according to DCPI detective Sophia Mason. Both were Hispanic. She was charged with harassment, menacing with a weapon and attempted assault.

All of her victims have been minorities. It seems she's a racist. :mad:
 
Some people think everyone is out to take advantage of them -- she sounds like one of these, but with a bad temper to boot. She attacked this person who had nowhere to run away from her, etc. It sounds like the former attack was the same -- get the "enemy" in a corner, and do whatever. She may have been treated badly somewhere before and has vowed to herself it will never happen again, so she is over-alert/paranoid about certain types of people (perhaps, but I don't want to assume), and makes sure she gets the upper hand immediately. She is a danger to anyone on a train/subway, and who knoze where else. And it could be that she might only "go after" someone weaker or smaller than she. What a bully. The next time, if there is one, she might really do permanent damage to someone. I hope LE is looking for her or has her already.

A straphanger caught on viral video kicking and hurling a racial slur at a fellow passenger was sentenced Wednesday to just probation and a day of anger management class — but not before she blew up again outside the courtroom.

“Did I say something f—ing funny?” Anna Lushchinskaya, 42, snapped at a reporter prior to her sentencing in Brooklyn Supreme Court, accusing the journalist of laughing at her while she answered questions.

By decision and order on motion dated May 25, 2021, this Court directed the respondent to show cause at a hearing before the Honorable Charles J. In determining an appropriate measure of discipline to impose, we have considered that at the prehearing conference, the respondent was indifferent, lacked decorum, and showed no remorse or acceptance of responsibility. The Court has also considered, inter alia, the nature of the criminal conduct in this matter and the respondent's failure to attend the hearing and failure to submit any mitigating evidence. Notwithstanding the respondent's lack of a disciplinary history, we conclude that the respondent's conduct warrants her suspension from the practice of law for a period of three years.
