HUNTS POINT, Bronx (WABC) -- The 20-year-old father of a 2-year-old boy found dead in the East River this week is now charged with second degree murder and manslaughter.

Ugh, what did he think was going to happen? Mom would just be like "Ok whatever"?
Was he trying to spend the rest of his life in prison? Sick.

Unfortunately, under New York Law, they probably can't charge him with 1st degree murder.
which is the intentional killing of a person without justification but you MUST HAVE at least one of the following aggravating factors:
  • The victim was a police officer, peace officer, correctional employee, judge, or a criminal case witness
  • The murder was committed while the perpetrator was serving a life sentence
  • The murder was committed with torture of the victim
  • The murder was committed as an act of terrorism
  • The murder was committed during the commission or attempted commission of one of the felonies under New York's felony murder laws ( (that includes robery, burglary, kidnapping, arson, first-degree rape, first degree criminal sexual act, first degree sexual abuse, aggragaved sexual abuse, first and second degree escape.)
  • Murder committed for hire (with the charge applying to both the murderer and the person who paid the murderer)
Second degree is the intentional killing without a felony under New Yorks felony murder rule. The only "good" thing about a second degree murder confiction is since the victim ws less than 14 years old he will NOT be eligible for parole if given a life sentence.

Thank you! I assumed it was something like that. I'm actually surprised they didn't also charge him with kidnapping, that would have helped. But either way, I'm sure they will do their best to make sure he never leaves prison, I hope so anyway.

Seriously, I wonder why they haven't also charged him with kidnapping, maybe it's some other detail in the law, but it says here that "The father appeared in Bronx Family Court on Monday to answer a warrant for failing to return the boy to the mother, per their custody agreement.
Montrell's father was put in jail by a judge after he failed to disclose the child's whereabouts."

Maybe due to the custody agreement... I don't know, I just fear he will be back out on the streets in 5-7 years and will likely impregnate another naïve girl shortly thereafter.

I hope he gets more then 5-7 for this. I think we're at the beginning of charges, Prosecutors are known to come up with more charges as they get into this ( sad as all get out) case. I pray he's done. IMO.

Montrell’s death follows the death of another child, Kyng Davis, a 3-year-old boy whose body was abandoned by his mother and her boyfriend at a hospital in Brooklyn.

No charges have been filed in Kyng’s death. But reporting from The New York Times revealed that the boy was being abused months before he died and that there were several missed chances, including some by law enforcement officials and family members, to intervene

During the arraignment, PIX11 News learned that the child was taken from his mother’s residence during a party, wearing a diaper and a shirt. 45 minutes later, Arius Williams reportedly showed up at another relative’s house without the child.
When family members asked where the baby was, Williams reportedly refused to tell them and ran away.

Montrell Williams was reportedly on a custodial visit during that weekend and was supposed to be back with his mother, Sierra Carroll, on May 11. On May 22, the family court issued a warrant to produce the child.

Video showed his activities before and after the alleged crime, including showing that the child was alive and in the father's arms on surveillance video immediately prior.

The child was standing, at one point, and then the video shows Williams throw the child over the bridge, then walk in front of a gas station without the child.

The document states that Carroll and her mother repeatedly urged the NYPD to take action until May 28, when a family court arrest warrant was issued for Arius Williams. Montrell's body was recovered in the East River near Ferry Point park on June 11.

This lawsuit claims that the city and NYPD failed to take "timely and reasonable action" to locate and protect the child, despite knowledge of the father's history of domestic violence, involvement of police in domestic disputes, the father's public social media statements of guilt, and the immediate danger to the child's life.
