Suspect in slaying of woman, toddler appears in court


LYONS — The man accused of murdering a woman and her baby in Wayne County appeared in court Tuesday afternoon.

The hearing was adjourned but not before Alberto Reyes renewed his request for a new attorney. Reyes was indicted on two counts of murder last month.

Everardo Donoteo-Reyes is charged with fraud and misuse of a permanent alien card, fraud and misuse of a Social Security card, and unlawful re-entry by a removed alien. The indictment was unsealed Jan. 10. He is scheduled to be arraigned on the new charges at 4 p.m. Thursday (1/17/19) at the federal building in Rochester.

When Donoteo-Reyes was arrested May 24 in Wayne County in connection with Hidalgo-Calderon's disappearance, the sheriff's office sent Donoteo-Reyes' fingerprints to ICE. An immigration records check found he had no valid immigration status.

During the missing person's investigation, the sheriff's office found fraudulent documents allegedly belonging to Donoteo-Reyes, including a counterfeit alien registration card in the name "Alberto Gutierrez" that had his photograph. Authorities said Donoteo-Reyes also had a fake Social Security card.

5/28/18: U.S. Immigration and Customs Enforcement, also known as ICE, says it has filed to have a man suspected in the death of the Sodus mother and the disappearance of her young son turned over to the federal agency. ICE says 25-year-old Gutierrez-Reyes is an illegally present citizen of Mexico. An official said Monday a detainer filed late last week will ensure Gutierrez-Reyes is turned over to ICE once any local charges are settled. 5/29/18: Case goes to Grand Jury.
5/29/18 Update: Sheriff Virts says he believes Donoteo-Reyes, who also goes by the name Alberto Ebavardo Gutierrez-Reyes, was involved in his girlfriend’s death. Donoteo-Reyes is scheduled to reappear in court on 7/2/18.
6/1/18: Deputies said he could face more charges once the results of an autopsy are released.
6/4/18: Federal Immigration hearing charged with re-entering U.S. illegally after being deported twice (arrested in Louisiana Fall of 2016, deported & March 2017 arrested in Texas, deported again), will be held w/o bail. Also charged with using falsified Soc. Sec. & Alien residency cards. Federal hearing in August. Both State & Federal cases will move ahead at the same time. He faces up to 10 years in prison on these charges. If found guilty in either case, will serve his sentence in U.S. before being deported upon his release.
7/16/18: Next hearing 9/21 re arguments about statements Reyes made to Sheriff investigators are admissible in court. (Not charged with murder yet, also faces Federal charges for re-entering U.S. illegally. 10/17/18: Hearing on 10/18. 10/18/18: Attorneys reviewed statements Donoteo-Reyes made to police after Selena's body was recovered in May as part of a hearing to determine if those statements could be allowed at trial.
12/17/18 Update: Reyes appeared in court Thursday (12/6). There, he begged the judge to intervene in his case. Clearly upset, Reyes rose from his seat and asked the judge to hear him out. He said he was tricked into giving up his right to remain silent and was repeatedly threatened by interrogators. Reyes begged the Judge to watch the whole interview (about 15 hours) DA only wanted to show 8 hours. Judge John Nesbitt agreed. He said he will take the next month to view the entire interrogation and have it translated from Spanish. Also wants a new public defender, says his is working with the DA. Grand Jury proceedings on 12/17. Reyes will be back in front of that judge on January 15. Whether or not he has a new attorney for that appearance is yet to be determined. 12/17/18: Grand Jury indicated & charged Reyes for 2 counts of 2nd degree murder & tampering with evidence. Arraignment held for murder charges. No bond. Next court date is 1/15.

Court docs detail new evidence in Wayne County mother, son homicide case

LYONS, N.Y. (WHEC) – Court documents detail the DNA and digital evidence collected from the murder scene of a young mother and her baby son.

In a conversation documented by an officer, Selena's mom stated that Reyes sent her a text on May 18 saying, "Selena left the state because she had to go to court in June and she did not want to go." The hearing was for her immigration status as Selena was seeking asylum.

On Feb. 25, the Wayne County Court received a handwritten motion by Alberto Reyes, which was written with the help of a fellow inmate.

In it, Reyes requests "permission to seek inmate assistance in reading, comprehending, and creating legal papers and legal materials." It goes on to explain he is unable to speak, read, or write English.

The next court hearing is scheduled for March 18.

It will be another Huntley Hearing where the judge will look into if Reyes was Mirandized and interrogated correctly. It will also look at information pulled from a cell-phone, and if that information was obtained legally.

In Wayne County Court Thursday, Judge John Nesbitt set March 18 for hearings in the case of Alberto Reyes. He faces two counts of second-degree murder and two counts of tampering with physical evidence in the deaths of Selena Hidalgo-Calderon and her son, Owen Hidalgo-Calderon.

Nesbitt authorized a Huntley hearing for that day to determine if statements made by Reyes during an interview with Wayne County sheriff’s investigators can be used at his trial. The trial is scheduled to begin June 24.

Reyes’ attorney, county Public Defender Andy Correia, called it a “lengthy interrogation” and a “substantial portion of the evidence in the case.”

There also may be a Mapp hearing, which determines if evidence can be suppressed due to search and seizure. Correia has asked Nesbitt to rule on whether there was probable cause for police to get search warrants for a building or buildings on the farm.

Sodus murder suspect's statements reviewed

A hearing Monday was to establish whether statements to police made by the suspect in the slaying of a mother and child can be used

In court Monday, Venosa testified how, over more than six hours of questioning, Reyes went from telling him he knew nothing of what happened to Selena or Owen to declaring he discovered Selena dead and admitting he had hidden her body in some woods.

Reyes’ attorney, public defender Andy Correia, quizzed Venosa on whether Reyes had been willingly speaking to him or was pressured to talk.

Venosa testified that Reyes had been advised of his right not to speak, or to have a lawyer present, and waived that right. Correia pointed out occasions during the interview when Reyes seemed to say he’d talked enough.

There has been no coverage that I am aware of.

According to VINELink, it appears he is in custody at Wayne County Jail, though I cannot say with absolute certainty since it says “Custody Status Date” is May 29th. It looks like maybe this particular jail updates inmate status information only periodically (jail website does not have an inmate roster available online):

On 6/5/19 - Order says - granting defense counsel's request for an extension to file defense motons without objection from govnmt counsel Defense motions now due by 7/8/19, gov't responses due 7/22/19, Oral argument reset from 6/19/19 to 7/29/19 9:30am before Feldman.

As to the murder case, I haven’t been able to find anything indicating that the trial is currently taking place .
