NY - Rita Tangredi, 31, and Colleen McNamee, 20, murdered, 1993-94, John Biltroff *GUILTY* - #2

  • Reanalyzed DNA evidence shows that another man's genetic material was found on a pair of men’s jeans discovered at the Shirley crime scene and Colleen McNamee's body in 1994, court papers show.
  • Authorities had been previously unable to create a profile from the DNA on the jeans and McNamee's body and therefore could not rule out they belonged to twice convicted killer John Bittrolff.
  • The dramatic new finding is contained in a 145-page filing from attorneys seeking to overturn Bittrolff's conviction by alleging someone else is more likely responsible for the crime.


They are also seeking to have sophisticated new DNA testing done on hairs found at the crime scene that have never been tested.

Suffolk County District Attorney Ray Tierney said Friday his staff has had preliminary discussions about the findings. "We’re now going to review it with our team and our DNA experts," he said.


Hair that has never been DNA tested, and DA's office reviewing. Let's hope they test everything and finally have the full picture.
 
Suffolk prosecutors are urging a judge to deny a motion by twice-convicted murderer John Bittrolff to vacate his conviction, arguing the Manorville carpenter’s latest attempt to clear his name is based on misconceptions about previous theories on the case and a misguided attempt to connect alleged Gilgo Beach serial killer Rex A. Heuermann to the killings.

Attorneys with the Legal Aid Society of Suffolk County filed the motion on behalf of Bittrolff in January after they said reanalyzed DNA evidence in the 1994 killing of Colleen McNamee revealed a profile of another man whose genetic material was found on a pair of “men’s jeans” discovered at the Shirley crime scene, a pair of black stretch pants, and on the victim. Bittrolff sought to have that profile compared with the FBI’s CODIS database and a profile of Heuermann, who is currently charged in the 1993 killing of Sandra Costilla, a case Bittrolff was previously a suspect in.

Prosecutors told Suffolk Supreme Court Justice Richard Ambro the motion should be denied in a filing Wednesday afternoon.

 
I'm struggling to wrap my head around why the motion to vacate for Bittrolff has been continued three times now, back in court June 11th to continue. I'm not a legal professional, can anyone advise? His attorneys submitted this application in January.
 
A Suffolk County jury reached its unanimous verdict after seven days of deliberations and after telling a judge three times that it was deadlocked.


Fair trial?

Doesn't look like it to me. The jury definitely didn't seem eager to convict, and that was without having all the evidence. THEN, the judge forced them to continue deliberating.

In my opinion, the Suffolk County court system should be doing everything possible to re-look at this case AND making everything public.

Naturally, the 2 (or 0.3) minute search for a match between the samples is warranted.

Yes, the defense filed a motion to vacate in January after DNA testing showed multiple contributors other than Bittrolff in Colleen's case as well as the men's jeans found at the scene with the name Michael M written in the waist band, as well as Rex being charged with the murder of Sandra Costilla who was originally thought to have been killed by Bittrolff.

Adjourned until Friday the 13th (boy I try not to be suspicious...) but the fact that they are resuming in two days instead of a month like usual, gives me hope!

Next date 6/13 - tomorrow

The evidence is mounting that he really may be innocent. I pray it doesn't take until the trial of Rex Heuermann to vacate Bittrolff. He has already been incarcerated for 11 years, 8 in Dannemora which makes it difficult for his wife and kids to visit.

I hope to God it doesn't have to wait for a guilty verdict on Rex in the murder of Sandra Costilla for the court to overturn Bittrolff's sentence.

If Suffolk is saying Rex is guilty based on the similarities of the crimes, logic should state that John is not guilty based on the victims' similarities to Rex's victims, right?
