New York state’s Office of Children and Family Services recorded a complaint about a child being forced to sleep in the garage at NYPD officer Mike Valva’s house in 2019 — the same garage where the cop and his fiancee are accused of freezing-to-death another son — but determined it to be “unfounded,” according to internal records reviewed by The Post.

The record, from a phone call logged on Feb. 27, 2019, states that Valva’s son Anthony was forced to sleep in the garage because he was urinating in his bed.

“For the past week, Anthony (9) has been coming to school with his clothes and backpack soaked in urine,” the OCFS record states.

“Anthony has been staying in the garage and is not allowed in his room due to him urinating in his bed … Step mother (Angela) and Father (Michael) are aware that the child is arriving at school soiled and fail to adequately address the concern,” the record says.

“The child’s feet and hands are bright red, but it unknown if this is as a result of the child being soaked in urine,” it adds.

The record shows the agency investigated the claim for one day and closed it as a “duplicate.” It’s not clear who reported it to the agency.

The memo is one of many narratives included in a record given to Anthony and Thomas’ mother, Justyna Zubko in May 2019.

“We believe certainly that Thomas was kept in the garage overnight preceding his death,” the commissioner said.

Prosecutors revealed at Valva’s arraignment that he and Pollina even taunted Thomas for being cold on the morning he died — after keeping him in the freezing garage all night.

Thomas was “face-planting” on the floor because he was hypothermic, Assistant District Attorney Laura Newcombe said, citing audio recordings taken from an extensive home-security system in the house.

In the recording, a child can be heard asking why Thomas cannot walk.

“Because he’s hypothermic,” Pollina replied, according to Newcombe. “When you wash with cold water and it’s freezing out you become hypothermic.”

Later, Pollina put the same question to Valva.

“Do you know why he’s falling?” Pollina asked Valva about Thomas, Newcombe said, citing recordings.

“Because he’s cold. Boo f–king hoo,” Valva callously responded, according to the prosecutor.

When Pollina apparently walked into the garage and asked Valva what he was doing, Valva said: “I’m f–king suffocating him that’s what I’m doing,” prompting Pollina to say, “Take your hands off his mouth. There are people everywhere,” according to Newcombe.


Home surveillance footage captured Thomas and Anthony sleeping on the concrete floor of the garage and “shivering” two nights before Thomas died, prosecutors said.

“They are on cold concrete. There are no pillows, no blankets, no mattress,” Newcombe said.

He will eventually be blazing eternally. At some point the judicial system needs to change. MOO

We should start with a major overhaul of USA-wide CPS departments, which are embarrassments dedicated towards "empowering" the adults to "be better parents". How about empowering some children for a change?!? :mad::mad::mad: . I'm so sick of these monsters. Who could hurt that handsome little boy?!?

This is beyond horrible. What I find especially repulsive is how two people can act in the same evil way towards a child. I will never understand that. I don't think anyone of us can.

I keep thinking, if only... if only... someone listened, someone suspected this was going on. This little boy should be alive today. This is heartwrenching.

The former nanny of 8-year-old Thomas Valva, who police say died after he was forced to sleep in a frigid garage in Center Moriches, spoke out on social media Friday.

"It breaks my heart to say I'm not surprised. I worked for this family and I knew how cruel they could be," Emily Gandolfo, who was a nanny right after college, said. "I was hired specifically to work with Thomas and his older brother because they were on the [autism] spectrum and needed extra care."

She added: "They were kids, they messed up sometimes and because of their disability they had a hard time understanding why what they did was not good behavior. I would disagree with Angela; their behavior was not bad. They would even listen in on my conversations with the children when I would try and tell them it was going to be okay. But to lock a child in 19 degree temps overnight — I'm disgusted."

Gandolfo said she took the children on nature walks and hikes and let them enjoy free time. "They always listened to me because I made sure to treat them kindly," she said.

On top of that, there is audio of parental alienation, which is a big deal in divorce/custody cases, but a lot of times it’s hard to prove. THERE WAS AUDIO PROOF!!! The judge should be ashamed of herself.

What poor soul had to listen to the recordings of the horror of that house? We have seen this type of surveillance in these abusive homes before. Disgusting to "watch" your kids to torture them more. The reports of sleeping in the garage in February....omg I am astounded that I am gullible enough to think there were no other times this punishment occurred, and thinking that the poor sweet pea died the only time he was in the garage. I feel guilty if my twenty years old adult working boys don't have home cooking from me, omg. They are complete monsters and need the heaviest charges against them. And these poor children need to have all their paperwork reviewed. These poor little ones may not look someone in the eye because they were beaten for the simple act of eye contact! They may not have proper gait walking because their limbs may have been damaged by fierce abuse! They may have poor sleeping habits and focusing issues because they were forced to sleep in a freezing garage! Disgusting to even think about.

In January 2018, Justyn Valva, uploaded a video to her Twitter page in which she says Michael Valva purposely squeezed the hands of their children in order to make them cry. Justyn’s handle on that page is StandAgainstChildAbuse. The last post on the page, from November 2018, reads, “I don’t even know if my children are still alive at this point. Please pray for my family and share this post with everyone to go viral and help my children receive justice that they deserve.”

Still SMH, angry and sorrowful about this situation for that little boy now gone. I've been reading about low body temps, and temps below 95 degrees F are dangerous -- SMH and almost in tears. At least this child was most likely unconscious (or whatever the state where he was in no pain) fairly quickly that horrible night. And then he was gone from his world of fear, pain and horror.
