Exactly my own thoughts.

There was a case in Florida a few years ago where the same thing happened.

That suspect was charged, and convicted of 2nd degree murder.

A misdemeanor charge is ridiculous, but nothing surprises me anymore when it comes to the criminal justice system in NY.
