Coroner IDs man killed in road rage shooting on I-275 in Colerain
In the 911 call, one person claims the shooting was in self-defense.
“It was self-defense, total self-defense,” the caller said.
Colerain police say this remains an active investigation, and no charges have been filed.
The man who was shot died, according to Colerain Township police. The Hamilton County Coroner's Office identified him as 47-year-old Eric Duke of Harrison.
Duke's passenger called 911 hysterical and sobbing saying someone "just shot my boyfriend."
The shooter was on the phone with 911 dispatchers at the same time, also emotional, and immediately claiming self defense.
Hopefully someone has dash cam video that will show what actually happened.from this link BBM

the witness said - "In the fast lane, they're both stopped and the driver in the car is laying face down on the ground,"
the shooter said - "911 please, a man was stopped just totally stopped in front and was trying to drag me out of the car and I freaking shot him because he was gonna (expletive) hurt me," the driver said. "He almost ran me off the road and then all I was tryna do was get away from the guy, and then he comes to a complete stop in the fast lane and he reverses the freaking truck and slams me."

Littleton says he was in the car with Duke Friday at about 6:45 p.m. going west on I-275, approaching the Blue Rock Road exit.
He says they were in the far right lane when a man in a pickup truck pulled up alongside them – driving on the shoulder. The man then apparently pulled in front of them, Duke honked, and the man hit his brakes, causing Duke to rear-end the pickup.

idk its all sus to me. i know road rage happens but im seeing a strange pattern.Hopefully someone has dash cam video that will show what actually happened.
Getting out of your vehicle during a road rage incident is just plain dangerous.If bystanders were calling 911 I'm sure an objective version of events can be put together. Generally speaking I expect the law will tend to favor the person who was trying to remain in his car.
Eric Duke, 36, was sentenced to 60 months in prison and ordered to pay $2,094,609.50 in restitution and forfeiture in the same amount. Duke pleaded guilty to three counts of conspiracy and four counts of lying to a bank or "Loan Fraud" back in September of 2010.
Duke admitted that he fraudulently obtained more than $6 million in mortgages for four luxury homes by filing fraudulent loan applications in the names of other people. He was a self employed tax preparer and interior designer. Duke also owned a property management company called Riverdale Property Management Group. L.P. in Maineville, OH.
Ohio's Stand Your Ground laws appear to be integral here. They are on the minds of the Colerain police as they gather evidence in this case and will be on the mind of prosecutors when it's decided whether to charge the shooter.
Three laws: The Castle Doctrine of 2008 means you can defend yourself in your car as well as your home; the Burden of Proof law of 2018 says the prosecution has to prove you did not act in self-defense, as opposed to you needing to prove that you did; and the Duty to Retreat law of 2021 says you are not obligated to retreat before using lethal force. But all of these presume you were defending yourself.
Witnesses apparently said that Duke drove on the shoulder, side-by-side with the pickup, and forced the other driver across multiple lanes of traffic before abruptly stopping his vehicle in front of the truck in the high-speed lane.
That's when, police say, he backed his van into the truck and got out to confront the driver, banging on the driver's side door.
Authorities say physical evidence at the scene was consistent with this version of the events, such as Duke's fingerprints on the truck driver's window, and his blood located on both the inside and outside of the car door.
At the point, Deters said witnesses claimed Duke got in front of the other vehicle and slammed on his brakes, forcing the driver to stop.
Duke got out of his van, approached the other vehicle, and tried to get inside, Deters said.
The other driver warned Duke he had a gun, the prosecutor explained.
Duke managed to hit the driver in the mouth, and the man fired one shot at the 47-year-old.
I know! I seldom use my horn, even if someone truly deserves it. Like sitting at a light that has changed to green and looking at their phone.shame. this is why i dont even look at other drivers anymore.
