Time ran out for Samuel Legg III to be restored to competency to stand trial for the murder of Sharon Kedzierski of Florida, whose body was found behind a former truck stop in Austintown in 1992.

Judge John Durkin of Mahoning County Common Pleas Court ruled Wednesday following a hearing that Legg must be confined to a state mental-health hospital and remain under the supervision of the judge indefinitely.

Legg’s mental health will be evaluated in six months and then every two years. The evaluations will guide the judge in determining whether Legg, a former truck driver, should remain hospitalized. Legg could remain hospitalized for the rest of his life.

Authorities had a year to “restore” Legg’s mental health sufficiently to stand trial, but that did not happen, Durkin said.

Thank you for the information. I can't help but think that the victims' family and friends must find this justice rather hollow. How many did he kill? 5? Regarding the ruling, I get it; but I really feel for the family and friends who waited so long for justice.

Attorneys agree on medication issue for man arrested in cold case Austintown murder | WKBN.com

YOUNGSTOWN, Ohio (WKBN) — Attorneys Wednesday in Mahoning County Common Pleas Court agreed on a proposed order for a man deemed incompetent to stand trial for the 1992 death of a woman found in Austintown who was not identified until 2013.

The agreement calls for Judge John Durkin ordering that doctors can force Samuel Legg, 52, to take his medications if they believe it is neccessary.

Judge Durkin declared Legg incompetent to stand trial and that his competency can not be restored after a report by mental health professionals who evaluated him reached the same conclusion. He was ordered to be held in a treatment facility with the hope that his competency can be restored.

A hearing was to be held Wednesday [1/6/21] before Judge Durkin after a doctor requested that an order be handed down allowing doctors to give Legg his medications by force if necessary. However, Legg’s attorneys, Rachel Cerni and Mark Lavelle, said their client told them he had never refused any medication and would agree to take any medications necessary.

The doctor who asked for the order was to testify via video conference, but he never appeared.

After the attorneys talked to the judge, they agreed on a proposed order for Judge Durkin to sign saying that if Legg was not taking his medications, doctors could force him to take them if necessary.

Lake County can’t access DOB 8/19/69
Will eventually be extradited to Illinois to face the charges.

There is a case for him but it only has warrants so far. There are no hearings past, present or in the future yet. The case number is 20CF00001164. The warrants were filed on 07-29-2020 when the case was opened. They are for Murder/Intent to Kill/Injure and Murder/Strong Prob Kill/Injure.

Based on earlier evaluations, Durkin found Legg incompetent to stand trial in June 2019 & ordered that Legg be sent to Twin Valley Behavioral Healthcare in Columbus. Authorities had a year to “restore” Legg’s mental health sufficiently to stand trial, but that did not happen, Durkin said. The hearing had testimony from Austintown detective Robert Whited. Part of the purpose of the hearing was to hear from Whited on the history of the case & evidence he & detective Greg McGlynn of the Austintown Police Dept. gathered. The truck stop was near state Route 46. Kedzierski’s oldest daughter, Katherine Kedzierski Kuring, was allowed to give a victim impact statement at the hearing, emotionally unloading on Legg as she read from prepared remarks that expressed the pain & frustration she experienced.
1/6/21 Update: Before Judge John M. Durkin a Judgment Entry: Legg appear via videoconference with his counsel attorney Mark Lavella & Rachel Cerni & State of Ohio by Assistant prosecuting attorney Dawn Cantalamessa & assistant prosecuting attorney Michael Yacovone for the motion for Court approval of medical treatment & administration of medication. Based on the stipulated report, the Court finds that Legg is in need of psychotropic meds & is mentally unable to receive information required to enable him to give a fully informed intelligent & knowing consent to specific treatment regimen. Next Notes for Court hearing on 3/29/21.

OH - *17 year old woman (Sept. 7, 1997, Medina County) - *Samuel William Legg III (27 @ time of crime/49/now 51) arrested (1/2018), charged & indicted (1/23/19) & arraigned (2/14/19) with 2 counts of rape. Plead not guilty. $1M bond. Medina County
Familial DNA match. Was extradited (Jan. 2018) from Chandler, AZ to Ohio.

9/16/20 Update: Legg will remain in state custody in Franklin County, where he is under treatment in an effort to make him competent enough to stand trial in Medina County. Medina County Common Pleas Court Judge Joyce Kimbler ruled Wednesday that prosecutors have at least an additional 6 months to restore Legg to competency. Legg is facing two rape charges in Medina County as well as two murder charges in Wood & Mahoning counties & an out-of-state murder charge in Illinois. At Wednesday's hearing, Legg's attorney argued that under Ohio law, if a defendant hasn't been restored to competency after being at a mental hospital for one year following a court order, the charges have to be dismissed. Legg was ordered to Twin Valley Behavioral Healthcare in September 2019. Judge Kimbler found that Legg, by refusing to take part in the hospital's treatment program, had stopped the running of the one-year restoration period. She found that the time period should be extended by 6 months & could be extended even longer if Legg continues to refuse to take part in his treatment, and ordered the hospital, through the state of Ohio, file monthly reports regarding Legg's cooperation with his treatment. Legg has been diagnosed with neurosyphilis & schizophrenia, according to the Ohio Attorney General's Office. Next hearing in February of 2021. Court site says competency hearing 1 year from 9/17/20, so put on 9/17/21.

Legg's DNA was linked to her death.
8/20/20 Update: Bench warrant issued. 8/27/20: Motion for determination of competency of defendant filed. Prosecuting Attorney's Request for Issuance of Warrant on Indictment-filed by Alyssa M. Blackburn Dolan. No update as of 3/29/21.

OH - *Angela Marie “Angie” Hicks (14) (disappeared July 21, 1990, found by Midway Mall on Aug. 30, 1990, Elyria, Lorain County) – suspect in ongoing investigation.
Legg (21 @ the time) was Angela’s step father. DNA link to 3 homicides in Ohio & 1 in Illinois.
