Bellefontaine mom’s psychological eval order heads to appeals court - October 7th

The lawyers for a Bellefontaine mom accused of killing her three sons have appealed a judge’s ruling that would force their client to undergo a psychiatric evaluation.

A decision from the appeals isn’t expected for at least a month.

The case against her has been slowly moving through the courts since she was charged. Trial dates have been pushed back multiple times and the appeal will further delay a trial from happening.

This is a horrible story. Truly terrible.
I know she has to be held accountable for the death of her babies, but I can’t help feel for this woman. Her entire life seemed to be full of abuse.
I hope this “husband” and maybe even her mother face more charges at some point.

Pilkington is scheduled to face a four-week-long trial starting on Jan. 7, 2019, according to online court records.

However, though the Logan County criminal case seems to be moving forward, an appeal filed to the Ohio Third District Court of Appeals has yet to be ruled on.

The issue at the center of the appeals court is whether an alleged confession by Pilkington that was recorded by police during an interview should be allowed as evidence during a jury trial.

The defense has filed motions to suppress the evidence from being heard because it says that confession isn’t true.

Pilkington’s team to seek Ohio Supreme Court ruling
Her trial has been delayed while her attorneys appealed a 2017 order from presiding Logan County Common Pleas Judge Mark S. O’Connor to undergo a forensic evaluation by a psychiatrist chosen by Logan County Prosecutor Eric Stewart’s office.

Third district justices agreed with Judge O’Connor’s ruling to order a forensic psychological evaluation and Stewart was moving ahead to schedule it.

However, it is again on hold as Judge O’Connor granted a stay of the evaluation on May 29.

Pilkington’s team has until the end of June to file an appeal with the Ohio Supreme Court.

An Ohio woman accused of suffocating her three sons out of jealousy at the attention given them by her husband — who was once her mother’s boyfriend — pleaded guilty Tuesday in the boys’ deaths and was sentenced to 37 years in prison.

Defendant Brittany Pilkington had been scheduled for trial early next year. The guilty pleas to involuntary manslaughter and murder took the death penalty off the table.

This guilty plea does not make me feel happy. She did horrible, horrible things! But, her "husband"/abuser is free. He has been held accountable for the things that he did!
