I don't see it so much her being jealous of her sons or that her controller was giving the boys more attention; I see it as her thinking that her boys would end up being abusers as well, so she has to 'get rid of them'.

Shortly before Niall’s death, the first in the series, Mrs. Pilkington also saw more abuse of girls in her family as her younger brother, Steven A. Cummins of Huntsville was charged in May 2014. Considering the events of her life, she probably thought the boys would eventually end up abusing her and their sister.

Her brother beat his daughter horribly. She was abused by her bio dad. She was sexually abused by her stepdad who ended up as her husband.

I just feel so bad for this girl. Her whole life sucked. She didn't get any help. Now she's probably going to spend the rest of it in prison.

Yes. The system failed her, and then it failed those three little babies.

Pilkington dad wants trial moved from Logan County, prosecutor removed

They also argue that Logan County Prosecutor Bill Goslee has a conflict of interest in the case because he previously represented Joseph Pilkington in a divorce and child custody case when he was a private practice attorney.
That case overlapped with the time period during which the prosecution claims his crime was committed.
“We assert that nothing could be more adverse than representing a person attempting to get custody of their children… and then prosecuting them for actions taken against another for whom he is accused of being in loco parentis,” the motion says.

Brittany Pilkington’s lawyers also filed a memorandum asking the judge not to order a competency hearing that has been requested by the prosecution.
They claim she is fully competent to stand trial, having attended six court hearings thus far and demonstrated that she understands the charges against her and the proceedings.

Both sides of the case met in front of a judge Wednesday to hear whether he would grant both of their requests to move the trial, scheduled to begin in just weeks on March 7.

Pilkington's defense wants confession thrown out, no death penalty
In a new set of motions filed in the case of a Bellefontaine mother accused of smothering her three young sons to death over a 13-month-period, her defense is once again asking for the death penalty specifications to be removed.

They are also seeking to sever the charges and hold three separate trials as well as to have her alleged confession thrown out because it was made involuntarily.

Brittany Pilkington’s legal team submitted six motions in Logan County Common Pleas Court on April 1, and Judge Mark O’Connor ordered on April 6 that the prosecution had 20 days to respond. If further hearings are required on these motions those will be scheduled at that time.

On Monday, the 44-year-old Pilkington put his own criminal case behind him by pleading guilty in Logan County Common Pleas Court to a misdemeanor charge for having sex with Brittany Pilkington, who is 20 years his junior, when she was underage and not yet his wife.

Joseph Pilkington, who now lives at Buckeye Lake, won’t have to serve jail or prison time but must register as a convicted sex offender annually for the next 15 years.

joseph pilkington was charged with sexual battery and arrested in september for allegedly starting a sexual relationship with brittany cummins while she was a minor and he was a step-father figure living in her home. He was involved in a relationship with her mother from the time she was a child....

The Bellefontaine mother accused of smothering her three sons to death appeared in court on Monday.

A judge set a May 15 deadline for attorneys to submit any additional motions in the case of Brittany Pilkington, Logan County Prosecutor Eric Stewart said. No new date for trial was set.

Doctors say Pilkington has brain damage, lawyers want confession out

The doctors conducted tests and interviews with Pilkington and concluded that she “falls in the mildly impaired range,” and that her, “verbal abilities exceed her ability to do nonverbal complex problem solving,” according to their affidavits.

Pilkington has an IQ of 78, according to their evaluations.

They also argue a lifetime of abuse and trauma made her compliant to the officers and caused the disassociated or “flat” aspect her interrogators noted.

“The dynamics of her interrogation mirrored the abuse and neglect she suffered throughout her life,” the motion argues. “She was isolated and trapped just as her mother and Joe Pilkington had done to her throughout her life.”
