It seems fairly straightforward. The prosecution is appealing the decision by the visiting judge to basically throw out parts of the plea agreement that Jake had signed.

The appeals court ruled against the prosecution so, in most normal states, the decision would be appealed to the higher court. That's the Ohio Supreme Court. If they're saying they don't have jurisdiction, it would be another example of legal malpractice by the Ohio courts, JMO.

The Ohio judicial system has problems, particularly the Ohio Supreme Court. JMO
It's time that this case and it's aftermath is brought up again to the public. To point out what is happening in the underbelly of the judicial system in Ohio. This could happen to any family. The average person probly does not know these kinds of shenanigans exist or can happen. JD Vance needs to put his finger on this.

Then he needs to become the contact person to reach out to JD Vance, this is his home. He would be able to see through or at least look into what is going on. Because there is definitely something going on. The sluethers here, especially of the local variety could fill in any gaps needed to be filled in.

The agreement EJW signed included no appeals, correct? Sentence written in stone, no? How did this change in sentence even occur? Judge was having a feel-good day and thought he pass on some good tidings? Is it not against every precedent to mess with a done plea deal that includes a full confessional!? I'm just so disillusioned that this can even be happening😱

IANAL, but I’ve never heard of a judge doing such a thing. I can’t see how this doesn’t violate good faith and trust in the judicial system.

I’m hoping this trial is dragging on so the judge will go back into retirement and a better qualified judge can replace him. Even better, Junk could retire, too.

Well there's still not trial date set, just in limbo until these appeals from the State are heard...or turned down. When will it be decided which it will be?

I didn’t find anything in the Ohio Supreme Court Public Docket. Will keep searching.

I couldn't even find BW's docket for the murders case. Only two cases came up and both were the stealing boots stuff. Ohio doesn't have a MyCase per se and what they do have is just crazy to trying and access his stuff...not user friendly for me anyway. I just wanted to read his docket on the Rhoden murders.

It’s not easy to find dockets for court cases in Ohio. It’s only fairly recently that information was available online. Ohio has never been good for access to public records. For many searches you had to physically go to public libraries, etc. Up until the last few years it was nearly impossible to research some major local newspaper archives without sending requests and paying quite a bit of money. Same with government records.

This is September.

On November 13th 2018 a big thing occurred - 6 arrested .... 4 charged with murder; 2 charged with cover-up for the Rhoden family and Hannah Gilley murders.

In just a couple months it will be 7 years since this arrest. Billy has been stuck behind bars in jail for 7 years without a trial.

No wonder he tried to overturn his Speedy Trial thing. He gave up, in court, his Speedy Trial Rights, most likely at the behest of his attorneys. So years later he, in his hand writing, tried to circumvent his attorneys by writing his own Motion to take back his right to have a Speedy Trial.

I can see why he did that. It was a grave mistake in my opinion that he surrendered his Speedy Trial Rights. Had he gone to trial BEFORE Jake and Angela confessed and agreed to testify, well the jury might have thought there was not enough reasonable doubt to convict him on such heavy charges.

Am I the only one who wonders about this?

He wrote it 2 years into his jail sentence and it is interesting to see what was going on at that time.

Well - from my notes I have Jake plead guilty on 4/22/21 & Angela on 9/10/21. So way before either one plead guilty.

The civil suit filed by Tony Rhoden was on 11/10/20. And GW4 was sentenced on 11/30/22.

I still don’t understand the court ruling against Tony Rhoden and family for civil charges against GW and the others.

Here's my notes on that:

9/7/23 Update: Plaintiffs' Notice of Voluntary Dismissal of Plaintiffs' Complaint as to all Defendants Without Prejudice filed by Brian K. Duncan & Adam lee Newmann.

It looks like it was dismissed without prejudice - so I believe he can file again if he wants.
