But the state’s special prosecutor successfully objected, citing a confidential informant who disclosed to investigators that Wagner IV and his family discussed revenge multiple times, as well as discussing how the incarcerated family member would have escaped from jail.

Already, prosecutors have suggested there may be a mole within the Wagner circle. When setting bond for Wagner IV’s grandmother, Fredericka Wagner, who pleaded not guilty to charges alleging she helped cover up the murders, prosecutors revealed at least one of the revenge conversations occurred at her farm."

I am also curious. I've been going back through the Discovery documents on the Media thread, but haven't gotten that far back yet. However, I sure thought I saw one for Billy that mentioned cell phone and BBL entries regarding custody. Over 500 on one Excel spreadsheet. JMO Thanks! But I could be just imagining that I saw it. So mind boggling!

"Included in the evidence list in Billy Wagner's case is an entry named "Custody Messages (1 excel sheet with 519 entries)."

So did they leave this out of his booking information? I can't imagine that it would be jail ink. The Waggies don't strike me as super intelligent, but that would be all kinds of stupid to get that ink post-arrest. On the other hand, stranger things...

Recall his attorney asked the judge to allow GW4 to be housed separately from others in jail. The reason given was that he likes the peace and quiet to read his Bible, etc. It gave me the impression he didn't get along with or socialize with other inmates, so it seems unlikely he would allow any of them to give him a tattoo. I suppose he could self-administer one. Seems odd, though, but it's not something I'm familiar with.

3 years 7 months -- trial #1

Rita's Forgery charges and the Wagner 4's Forgery charges are all tied to the same Custody Documents. If Rita's trial proves the Custody Documents were forged then we can expect better odds of the Wagner 4 being convicted on this charge.

On top of that, if the Documents are forged then it shows motive and premeditation. The Documents talk about Custody in the event of Hanna Rhoden's death and then a few weeks later she is killed and what are the odds of that?

Point is that if Rita is convicted of fraud, it could have a big effect on the Wagner 4 trials....setting the stage...My 2 Cents...........

Yes, custody is the primary motive for the murders, according to LE. But proof of forgery of custody documents isn't the linchpin of all the cases. If the state is unable to convince the jury it has enough proof that RN forged some custody or guardianship documents, it doesn't negate the fact that custody was obviously a big motive for the murders. There's evidence that JW was fighting for custody of S and there's plenty of evidence that the W's killed the Rhoden family and Hannah Gilley.

But, yes, RN's trial could reveal a lot about the details of the murders and the W's planning and execution. It will all be very interesting! Glad everyone is checking in to follow.

I agree if they can’t prove she forged the documents, it doesn’t mean they weren’t forged or that there wasn’t a custody battle.

"At least one..." (they had more than one conversation about revenge and escaping)." JMO

They probably didn't find shell casings because they used brass catchers.

Didn't GR's dad say in a video interview that BCI told him they found two different calibers of shell casings? I searched for the video but none I found include him making this statement, though I know I saw it numerous times.

Mr. Rhoden said back then, "it was more than one (killer), it was more than two..." He also said they told him GR was shot three times in the head.

The statement must be in the video taken by the reporter that showed up late in the video below, haven't found that yet.

"That confirms what the father of victim Gary Rhoden, told 10TV late last week. Kenneth Rhoden said the coroner told him two different bullet casings were found at the scene."

Father of Pike Co. murder victims says killer should be tortured

"Kenneth said according to the coroner there were two different bullet casings found at the scene, leading him to believe this crimes were the acts of more than one person."
