Angela was set on Rita’s attorney trying to get in that tote marked important stuff, they should have let him and Rita view it in a private room with cameras everywhere, also all evidence inside would be copy’s not original and see if any came up missing from the tote, JMO

Often the prosecution will tack on allocution as part of the plea deal. I'm hopeful that if a deal is offered, that will be the case here.

should be available, they set next weeks trial specifically on those dates because he is available to testify. I doubt it has anything to do with him but could be related to other witnesses. I hope it's not because the prosecution needs more time to gather evidence. They have had a whole year.

New journal entries on RN's court record yesterday and today. I especially like the "no clothing with messages," and assume that will be a standard for all the trials.

REASON FOR CONTINUANCE:
According to a filing by the defense, opposing the continuance, prosecutors say they need more time to review documents the state received from Newcomb's attorney yesterday. Attorney Frank Gerlach claims he still has not received documents he needs from prosecutors.

Who runs the Court? The Prosecution or Judge Deering? Rita was arrested a whole year ago and the Judge should enforce deadlines for document reveals. So this last minute stuff doesn't happen. Her trial has been postponed once already.

Where it stands is the State filed a Motion to continue (postpone) the trial and the defense filed a Memorandum Contra which is an
explanation to the court of why the Stare's Motion should be denied.

Rita wants to go to trial Monday but the prosecution isn't ready and wants to delay it.

Hopefully Judge Deering will rule on this tomorrow. He has to. Tomorrow, Friday, is the last business day before the trial Monday.

Didn't the Defense just supply new discovery on 11/13?

There should have been a deadline for discovery (if there wasn't) OR the Judge should disallow that discovery OR reschedule trial.

I think it's the fault of the defense and not the state.

BBM. Perhaps that's what worried them. I'm not an expert, but maybe RN's attorneys are trying to find a way to make all the "tote" evidence inadmissible in court. Trying to find some technicality to get it tossed. JMO.

I'd like it if every doggone one of them had a permanent scar or physical injury out of the deal...some daily physical reminder that even though they attacked men, women, and children like cowards in the dead of night, that the Rs still fought back and managed to wound them.
